Short description: CRIM ID-EXPUNGE Synopsis of Bill as introduced: Amends the Criminal Identification Act. Provides that the arrest, conviction, and court records of a person convicted of a Class 4 felony, other than a sex crime or crime of violence, are expunged after completion of the person's sentence if the person has not been convicted of a felony or misdemeanor within the previous 4 years. Effective immediately. FISCAL NOTE (Illinois Courts Administrative Office) HB 4097 would have a limited fiscal impact on the judicial branch at the State level, but compliance with its provisions would impose significant new costs on the circuit courts. It is not possible to provide a dollar estimate of the fiscal impact of HB 4097, because the number of records affected is not known and procedures would need to be developed to implement the legislation. JUDICIAL NOTE (Illinois Courts Administrative Office) HB 4097 would increase judicial workloads. However, it is not anticipated that the bill would increase the number of judges needed in the State. FISCAL NOTE (Department of Corrections) There would be no fiscal impact or impact on the corrections population. CORRECTIONAL NOTE (Department of Corrections) Same as DOC fiscal note.
