AMENDMENT TO SENATE BILL 3301

2    AMENDMENT NO. ______. Amend Senate Bill 3301 on page 1,
3line 5, after "40", by inserting "and adding Section 22"; and
 
4on page 1, immediately below line 5, by inserting the
5following:
 
6    "(215 ILCS 121/22 new)
7    Sec. 22. Criminal history record check; application for
8certificate and certificate renewal.
9    (a) For the purpose of this Section, "fingerprints" means
10an impression of the lines on the finger taken for the purpose
11of identification. The impression may be electronic or in ink
12converted to electronic format.
13    (b) In order to make a determination of certification
14eligibility, the Director is authorized to require all
15applicants for a certificate, including renewal applicants, to
16undergo a fingerprint-based criminal history record check for

1the first year following the effective date of this amendatory
2Act of the 98th General Assembly. The applicant shall submit
3his or her fingerprints to the Department of State Police in
4the form and manner prescribed by the Department of State
5Police. The fingerprints shall be transmitted by a live scan
6fingerprint vendor licensed by the Department of Financial and
7Professional Regulation. The fingerprints shall be checked
8against the fingerprint records filed in the Department of
9State Police and Federal Bureau of Investigation criminal
10history records databases. The Department of State Police shall
11charge a fee for conducting the criminal history record check,
12which shall be deposited in the State Police Services Fund and
13shall not exceed the actual cost of the State and national
14criminal history record check. The Department of State Police
15shall furnish, pursuant to positive identification, all
16Illinois conviction information to the Department of Insurance
17and shall forward the national criminal history record
18information to the Department of Insurance.".
