AMENDMENT TO SENATE BILL 3301

2    AMENDMENT NO. ______. Amend Senate Bill 3301 on page 1,
3line 5, after "40", by inserting "and adding Section 22"; and
 
4on page 1, immediately below line 5, by inserting the
5following:
 
6    "(215 ILCS 121/22 new)
7    Sec. 22. Criminal history record check; application for
8certificate and certificate renewal.
9    (a) For the purpose of this Section, "fingerprints" means
10an impression of the lines on the finger taken for the purpose
11of identification. The impression may be electronic or in ink
12converted to electronic format, with an identity verification
13method authorized by the Department of State Police and the
14Department of Financial and Professional Regulation.
15    (b) In order to make a determination of certification
16eligibility, the Director is authorized to require all

1applicants for certification to undergo a fingerprint-based
2criminal history record check for an initial certification and,
3for an individual holding a certificate on the effective date
4of this amendatory Act of the 98th General Assembly, for the
5first renewal of a certificate. Each navigator applying for
6certification or renewal shall submit his or her fingerprints
7to the Department of State Police in the form and manner
8prescribed by the Department of State Police. The fingerprints
9should be transmitted through a live scan fingerprint vendor
10licensed by the Department of Financial and Professional
11Regulation. The fingerprints shall be checked against the
12fingerprint records now and hereafter filed in the Department
13of State Police and Federal Bureau of Investigation criminal
14history records databases. The Department of State Police shall
15charge a fee for conducting the criminal history record check,
16which shall be deposited in the State Police Services Fund and
17shall not exceed the actual cost of the State and national
18criminal history record check. The Department of State Police
19shall furnish, pursuant to positive identification, all
20Illinois conviction information to the Department of Insurance
21and shall forward the national criminal history record
22information to the Department of Insurance.".
