| AN ACT concerning regulation.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Barber, Cosmetology, Esthetics, and Nail
| 5 |
| Technology Act of 1985 is amended by changing Sections 1-7 and | 6 |
| 2-4 as follows:

| Sec. 1-7. Licensure required; renewal.
| 10 |
| (a) It is unlawful for any person to practice, or to hold | 11 |
| himself or
herself out to be a cosmetologist, esthetician, nail | 12 |
| technician, or
barber without a license as a cosmetologist,
| 13 |
| esthetician, nail technician, or barber issued by the | 14 |
| Department of
Professional Regulation pursuant to the | 15 |
| provisions of this Act and of the
Civil Administrative Code of | 16 |
| Illinois. It is also unlawful for any person,
firm, | 17 |
| partnership, or corporation to own, operate, or conduct a
| 18 |
| cosmetology, esthetics, nail technology, or barber school
| 19 |
| without a license
issued by the Department or to own or operate | 20 |
| a cosmetology, esthetics, or nail
technology salon or barber | 21 |
| shop without a certificate of registration issued
by the | 22 |
| Department. It is further unlawful for any person to teach in | 23 |
| any
cosmetology, esthetics, nail technology, or barber college | 24 |
| or school
approved by the Department or hold himself or herself | 25 |
| out as a cosmetology,
esthetics, nail technology, or barber | 26 |
| teacher without a license as a teacher,
issued by the | 27 |
| Department
or as a barber clinic teacher or cosmetology, | 28 |
| esthetics,
or nail technology clinic teacher without a license | 29 |
| as a clinic teacher issued
by the
Department.

| (b) Notwithstanding any other provision of this Act, a | 31 |
| person licensed as a
cosmetologist may hold himself or herself | 32 |
| out as
an esthetician and may engage in the practice of |

| esthetics, as defined in this
Act, without being licensed as an | 2 |
| esthetician. A person
licensed as a cosmetology teacher may
| 3 |
| teach esthetics or hold himself or herself out as an esthetics | 4 |
| teacher without
being licensed as an esthetics teacher. A | 5 |
| person
licensed as a cosmetologist may hold himself or herself | 6 |
| out
as a nail technician and may engage in the practice of nail | 7 |
| technology, as
defined in this Act, without being licensed as a | 8 |
| nail
technician. A person licensed as a cosmetology teacher may
| 9 |
| teach nail technology and hold himself or herself out as a nail | 10 |
| technology
teacher without being licensed as a nail
technology | 11 |
| teacher.
| 12 |
| (c) A person licensed as a barber teacher may hold himself | 13 |
| or herself out
as a barber and may practice barbering without a | 14 |
| license as a barber. A person
licensed as a cosmetology teacher | 15 |
| may hold himself or herself out as a
cosmetologist, | 16 |
| esthetician, and nail technologist and may practice | 17 |
| cosmetology,
esthetics, and nail technology without a license | 18 |
| as a cosmetologist,
esthetician, or nail technologist. A person | 19 |
| licensed as an esthetics teacher
may hold himself or herself | 20 |
| out as an esthetician without being licensed as an
esthetician | 21 |
| and may practice esthetics. A person licensed as a nail | 22 |
| technician
teacher may practice nail technology and may hold | 23 |
| himself or herself out as a
nail technologist without being | 24 |
| licensed as a nail technologist.
| 25 |
| (d) The holder of a license issued under this Act may renew | 26 |
| that license during the month preceding the expiration date of | 27 |
| the license by paying the required fee.

| Sec. 2-4. Licensure as a barber
teacher; qualifications. | 32 |
| (1) A person is qualified to receive a license as a barber | 33 |
| teacher if that person files an
application on forms provided | 34 |
| by the Department, pays the required fee, and:
| 35 |
| a. Is at least 18 years of age;

| b. Has graduated from high school or its equivalent;
| 2 |
| c. Has a current license as a barber;
| 3 |
| d. Has graduated from a barber school approved by the | 4 |
| Department
having either:
| 5 |
| (1) completed a total of 500 hours in barber | 6 |
| teacher training extending
over a period of not less | 7 |
| than 3 months nor more than 2 years and has had 3
years | 8 |
| of practical experience as a licensed barber; or
| 9 |
| (2) completed a total of 1,000 hours of barber | 10 |
| teacher training extending
over a period of not less | 11 |
| than 6 months nor more than 2 years; and
| 12 |
| e. Has passed an examination authorized by the | 13 |
| Department
to determine fitness to receive a license
as a | 14 |
| barber teacher; and
| 15 |
| f. Has met any other requirements set forth in this | 16 |
| Act.
| 17 |
| An applicant who is issued a license as a Barber | 18 |
| Teacher is not required
to maintain a barber license in | 19 |
| order to practice barbering as defined in this
Act.
| 20 |
| (2) A person is qualified to receive a license as a barber | 21 |
| clinic
teacher if he or she has applied in writing on forms | 22 |
| provided by the
Department, has paid the required fees, and:
| 23 |
| (A) is at least 18 years of age;
| 24 |
| (B) has graduated from high school or its equivalent;
| 25 |
| (C) has a current license as a barber; and
| 26 |
| (D) has either: (i) completed a program of 500 hours of | 27 |
| teacher
training in
a licensed barber school and had 2 | 28 |
| years of practical
experience as a licensed barber within 5 | 29 |
| years
preceding the examination; or (ii) completed a | 30 |
| program of 1,000 hours of
teacher training in
a
licensed | 31 |
| barber school.

| Section 99. Effective date. This Act takes effect upon | 34 |
| becoming law.
