SYNOPSIS AS INTRODUCED:
 
20 ILCS 1705/4.3   from Ch. 91 1/2, par. 100-4.3

    Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that the Department of Human Services shall establish a system of regular and ongoing on-site inspections of each facility under its jurisdiction including surveillance procedures designed to identify and prevent abuse and neglect. Provides that the surveillance procedures must include, but not be limited to, the use of security cameras and the use of persons to perform covert investigations of the daily operation of the facility.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by changing Section
6 4.3 as follows:
 
7     (20 ILCS 1705/4.3)  (from Ch. 91 1/2, par. 100-4.3)
8     Sec. 4.3. Site visits and inspections.
9     (a) (Blank).
10     (b) The Department shall establish a system of regular and
11 ongoing annual on-site inspections of each facility under its
12 jurisdiction including surveillance procedures designed to
13 identify and prevent abuse and neglect. The surveillance
14 procedures must include, but not be limited to, the use of
15 security cameras and the use of persons to perform covert
16 investigations of the daily operation of the facility. The
17 inspections shall be conducted by the Department's central
18 office to:
19         (1) Determine facility compliance with Department
20     policies and procedures;
21         (2) Determine facility compliance with audit
22     recommendations;
23         (3) Evaluate facility compliance with applicable

1     federal standards;
2         (4) Review and follow up on complaints made by
3     community mental health agencies and advocates, and on
4     findings of the Human Rights Authority division of the
5     Guardianship and Advocacy Commission; and
6         (5) Review administrative and management problems
7     identified by other sources.
