AMENDMENT TO SENATE BILL 2173

2     AMENDMENT NO. ______. Amend Senate Bill 2173, AS AMENDED,
3 in Section 5, by replacing Sec. 16-164 with the following:
 
4     "(40 ILCS 5/16-164)  (from Ch. 108 1/2, par. 16-164)
5     Sec. 16-164. Board - appointed members - vacancies. Terms
6 of office for the appointed members shall begin on July 15 of
7 an even-numbered year, except that the terms of office for
8 members appointed pursuant to this amendatory Act of the 96th
9 General Assembly this amendatory Act of the 96th General
10 Assembly shall begin upon being confirmed by the Senate. The
11 Governor shall appoint 2 3 members as trustees with the advice
12 and consent of the Senate in each even-numbered year who shall
13 hold office for a term of 4 years, except that, of the members
14 appointed pursuant to this amendatory Act of the 96th General
15 Assembly this amendatory Act of the 96th General Assembly, 2 3
16 members shall be appointed for a term ending July 14, 2012 and
17 2 3 members shall be appointed for a term ending July 14, 2014.

1 Each such appointee shall reside in and be a taxpayer in the
2 territory covered by this system, shall be interested in public
3 school welfare, and experienced and competent in financial and
4 business management. A vacancy in the term of an appointed
5 trustee shall be filled for the unexpired term by appointment
6 of the Governor.
7     Notwithstanding any provision of this Section to the
8 contrary, the term of office of each member of the Board
9 appointed by the Governor, including any temporary
10 appointment, who is sitting on the Board on the effective date
11 of this amendatory Act of the 96th General Assembly this
12 amendatory Act of the 96th General Assembly is terminated on
13 that effective date. A trustee sitting on the Board on the
14 effective date of this amendatory Act of the 96th General
15 Assembly shall this amendatory Act of the 96th General Assembly
16 may not hold over in office for more than 60 days after the
17 effective date of this amendatory Act of the 96th General
18 Assembly. Nothing in this Section shall prevent the Governor
19 from making a temporary appointment or nominating a trustee
20 holding office on the day before the effective date of this
21 amendatory Act of the 96th General Assembly this amendatory Act
22 of the 96th General Assembly.
