AMENDMENT TO HOUSE BILL 4970

2    AMENDMENT NO. ______. Amend House Bill 4970 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Sections 5.811 and 6z-93 as follows:
 
6    (30 ILCS 105/5.811 new)
7    Sec. 5.811. The Veterans' Prosthesis Fund.
 
8    (30 ILCS 105/6z-93 new)
9    Sec. 6z-93. The Veterans' Prosthesis Fund; creation. The
10Veterans' Prosthesis Fund is created as a special fund in the
11State treasury. Moneys in the Fund shall be used by the
12Department of Veterans' Affairs for the purpose of making
13grants to Illinois veterans to update and replace the veteran's
14existing prosthesis. The Department shall adopt rules
15concerning eligibility for the grants. The Fund may receive

1moneys from the disabled veterans income tax checkoff created
2in Section 507AAA of the Illinois Income Tax Act, as well as
3public and private donations. All federal funds made available
4to the State for the purpose of aiding veterans in updating or
5replacing prostheses shall be deposited into the Veterans'
6Prosthesis Fund.
 
7    Section 10. The Illinois Income Tax Act is amended by
8adding Section 507AAA as follows:
 
9    (35 ILCS 5/507AAA new)
10    Sec. 507AAA. Disabled veterans checkoff. For taxable years
11ending on or after December 31, 2012, the Department shall
12print, on its standard individual income tax form, a provision
13indicating that, if the taxpayer wishes to contribute to funds
14established for the purpose of assisting disabled veterans and
15their families, as authorized by this amendatory Act of the
1697th General Assembly, then he or she may do so by stating the
17amount of the contribution (not less than $1) on the return and
18indicating that the contribution will reduce the taxpayer's
19refund or increase the amount of payment to accompany the
20return. Of the moneys collected under this Section: one-third
21shall be deposited into the Veterans' Prosthesis Fund;
22one-third shall be deposited into the Illinois Military Family
23Relief Fund; and one-third shall be deposited into the Disabled
24Veterans Property Tax Relief Fund. The taxpayer's failure to

1remit any amount of the increased payment reduces the
2contribution accordingly. This Section does not apply to any
3amended return.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
