AMENDMENT TO HOUSE BILL 5332

AMENDMENT NO. ______. Amend House Bill 5332 on page 2, by replacing lines 8 through 16 with the following:

"Section 15. Associations; prohibitions. Notwithstanding any provision of this Act or other provision of law, the governing entity of a homeowners' association, common interest community association, or condominium unit owners' association shall not, by the adoption of any bylaw or the exercise of any power, prohibit the ownership of an electric vehicle, prohibit the continuous charging of an electric vehicle, or prohibit the installation of an electric vehicle charging station unless such installation would be physically impossible or present an undue burden on the association. The governing entity of a homeowners' association, common interest community association, or condominium unit owners' association shall not, by the adoption of any bylaw or the exercise of any power, prohibit the installation or use of an electric vehicle charging station on private property."; and

on page 3, line 15, by deleting "and"; and

on page 3, line 19, by replacing "area" with "area; and (iii) responsibility for installation costs and utility costs associated with ongoing use of charging stations".
