| 1 | | on or after the effective date of this amendatory Act of the | 2 | | 98th General Assembly with respect to service on that Board. | 3 | | Section 15. The Metropolitan Transit Authority Act is | 4 | | amended by changing Sections 19 and 22 as follows:

| 6 | | Sec. 19. Compensation; pension; benefits. | 7 | | (a) The governing and administrative body of the Authority | 8 | | shall be a
board consisting of seven members, to be known as | 9 | | Chicago Transit Board.
Members of the Board shall be residents | 10 | | of the metropolitan area and persons of
recognized business | 11 | | ability. No member of the Board of the
Authority shall hold any | 12 | | other office or employment under the Federal,
State or any | 13 | | County or any municipal government except an honorary office
| 14 | | without compensation or an office in the National Guard. No | 15 | | employee of
the Authority shall hold any other office or | 16 | | employment under the Federal,
State or any County or any | 17 | | municipal government except an office with
compensation not | 18 | | exceeding $15,000 annually or a position in the National
Guard | 19 | | or the United States military reserves. Provided, however,
that | 20 | | the Chairman may be a member of the Board of the Regional | 21 | | Transportation
Authority. No member of the
Board or employee of | 22 | | the Authority shall have any private financial
interest, profit | 23 | | or benefit in any contract, work or business of the
Authority | 24 | | nor in the sale or lease of any property to or from the

| 1 | | Authority. | 2 | | (b) The provisions of this subsection (b) apply only for | 3 | | terms of office beginning before the effective date of this | 4 | | amendatory Act of the 98th General Assembly. The salary of each | 5 | | member of the initial Board shall be
$15,000.00 per annum, and | 6 | | such salary shall not be increased or diminished
during his or | 7 | | her term of office. The salaries of successor members of the
| 8 | | Board shall be fixed by the Board and shall not be increased or | 9 | | diminished
during their respective terms of office. No Board | 10 | | member shall be allowed
any fees, perquisites or emoluments, | 11 | | reward or compensation for his or her
services as a member or | 12 | | officer of the Authority aside from his or her
salary or | 13 | | pension, but he or she shall be reimbursed for actual expenses
| 14 | | incurred by him or her in the performance of his or her duties. | 15 | | (c) For terms of office beginning on or after the effective | 16 | | date of this amendatory Act of the 98th General Assembly, | 17 | | members of the Board shall be compensated $500 for attendance | 18 | | at each meeting of the Board and for actual expenses incurred | 19 | | in travel to and from those meetings but shall not be otherwise | 20 | | compensated for service as a member of the Board.
| 21 | | For individuals who first become members of the Board on or | 22 | | after the effective date of this amendatory Act of the 98th | 23 | | General Assembly, no service or contribution shall be credited | 24 | | in any retirement system or pension fund, under the Illinois | 25 | | Pension Code or otherwise, for service on the Board, and no | 26 | | public funds shall be appropriated, expended, or otherwise |

| 17 | | Sec. 2.17. Employee Pensions.
| 18 | | (a) The Authority may establish and maintain systems of | 19 | | pensions and
retirement benefits for such officers and | 20 | | employees of the Authority as may
be designated or described by | 21 | | ordinance of the Authority; may fix the
classifications | 22 | | therein; may take such steps as may be necessary to provide
| 23 | | that persons eligible for admission to such pension systems as | 24 | | officers and
employees of the Authority or of any |

| 1 | | transportation agency whose operations
are financed in whole or | 2 | | in part by the Authority, shall retain eligibility
for | 3 | | admission to or continued coverage and participation under | 4 | | Title II of
the federal Social Security Act, as amended, and | 5 | | the related provisions of
the Federal Insurance Contributions | 6 | | Act, as amended, or the federal
Railroad Retirement Act, as | 7 | | amended, and the related provisions of the
Railroad Retirement | 8 | | Tax Act, as amended, as the case may be; and may
provide in | 9 | | connection with such pension systems, a system of benefits
| 10 | | payable to the beneficiaries and dependents of any participant | 11 | | in such
pension systems after the death of such participant | 12 | | (whether accidental or
otherwise, whether occurring in the | 13 | | actual performance of duty or
otherwise, or both) subject to | 14 | | such exceptions, conditions, restrictions
and classifications | 15 | | as may be provided by ordinance of the Authority. Such
pension | 16 | | systems shall be financed or funded by such means and in such
| 17 | | manner as may be determined by the Authority to be economically | 18 | | feasible. | 19 | | (b) Beginning on the effective date of this amendatory Act | 20 | | of the 98th General Assembly, the Authority shall not grant any | 21 | | new benefit increase. As used in this subsection (b), "new | 22 | | benefit increase" means (i) an increase in the amount of any | 23 | | benefit provided under the authority of an ordinance adopted | 24 | | under this Section that takes effect after the effective date | 25 | | of this amendatory Act of the 98th General Assembly and (ii) an | 26 | | expansion of the conditions of eligibility for any benefit |
