AMENDMENT TO SENATE BILL 3336

AMENDMENT NO. ______. Amend Senate Bill 3336 by replacing everything after the enacting clause with the following:

"Section 5. The Pharmacy Practice Act is amended by adding Section 30.1 as follows:

(225 ILCS 85/30.1 new)

Sec. 30.1. Reporting of termination for cause.

(a) A pharmacist in charge shall report to the Department within 60 days when a pharmacist, registered certified pharmacy technician, or registered pharmacy technician is terminated from employment for cause, as defined by rule. If a pharmacist in charge is terminated by a pharmacy for cause, it shall be the responsibility of the pharmacy to report that termination to the Department within 60 days.

(b) The report of a termination for cause shall include documentation of the reason for the termination, including any underlying pharmacy records used to reach the decision to terminate, as described by rule.

(c) Any individual or organization acting in good faith, and not in a willful and wanton manner, in complying with this Section by providing any report or other information to the Department or by participating in proceedings of the Department shall not, as a result of such actions, be subject to criminal prosecution or civil damages.

(d) Any information reported or disclosed shall be kept for the confidential use of the Department and shall not be disclosed to anyone other than as provided in Section 2105-117 of the Department of Professional Regulation Law of the Civil Administrative Code of Illinois.

Section 99. Effective date. This Act takes effect upon becoming law.".
