SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.50 new

    Amends the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to make application to the federal Centers for Medicare and Medicaid Services by July 1, 2017 for a State plan amendment to implement the Community First Choice Option pursuant to the Social Security Act. Requires the Department, beginning on July 1, 2017, but no later than July 1, 2018, to submit applications to the federal Centers for Medicare and Medicaid Services for all Medicaid funding options available for people with intellectual and developmental disabilities, including a research and demonstration waiver application pursuant to the Social Security Act. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.50 as follows:
 
6    (305 ILCS 5/12-4.50 new)
7    Sec. 12-4.50. Community First Choice Option; research and
8demonstration waiver application. In order to provide home and
9community-based long-term services and supports to individuals
10who are eligible for medical assistance as an alternative to
11institutional services and in order to ensure that the State
12may access maximum federal matching funds, the Department of
13Healthcare and Family Services shall make application to the
14federal Centers for Medicare and Medicaid Services by July 1,
152017 for a State plan amendment to implement the Community
16First Choice Option pursuant to 1915(k) of the Social Security
17Act. In addition, beginning on July 1, 2017, but no later than
18July 1, 2018, the Department shall submit applications to the
19federal Centers for Medicare and Medicaid Services for all
20Medicaid funding options available for people with
21intellectual and developmental disabilities, including a
22Section 1115 research and demonstration waiver application
23pursuant to Section 1115 of the Social Security Act.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
