SYNOPSIS AS INTRODUCED:

35 ILCS 200/21-385

    Amends the Property Tax Code. In a Section requiring a receipt for payment of certain fees and costs incurred by a certificate holder, provides that the county clerk shall write or stamp the date of receiving upon the receipt. In a Section concerning notice of an extended period of redemption, provides that the county clerk shall write or stamp the date of receipt upon the notice, and provides that the county clerk is not required to extend the period of redemption unless the purchaser or his or her assignee obtains that acknowledgement of delivery. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Property Tax Code is amended by changing
5Sections 21-360 and 21-385 as follows:
 
6    (35 ILCS 200/21-360)
7    Sec. 21-360. Posting requirements. Except as otherwise
8provided in Section 21-355, the county clerk shall not be
9required to include amounts described in paragraphs (c) through
10(k) of Section 21-355 in the payment for redemption or the
11amount received for redemption, nor shall payment thereof be a
12charge on the property sold for taxes, unless the tax
13certificate holder has filed and posted with the county clerk
14prior to redemption and in any event not less than 30 days
15prior to the expiration of the period of redemption or extended
16period of redemption an official, original or duplicate receipt
17for payment of those fees, costs and expenses permitted under
18paragraphs (c) through (k) of Section 21-355. Upon receiving an
19official, original, or duplicate receipt, the county clerk
20shall write or stamp the date of receiving upon the receipt.
21The county clerk shall not be required to include amounts
22described in paragraphs (c) through (k) of Section 21-355
23unless the purchaser or his or her assignee obtains this

6    Sec. 21-385. Extension of period of redemption. The
7purchaser or his or her assignee of property sold for
8nonpayment of general taxes or special assessments may extend
9the period of redemption at any time before the expiration of
10the original period of redemption, or thereafter prior to the
11expiration of any extended period of redemption, for a period
12which will expire not later than 3 years from the date of sale,
13by filing with the county clerk of the county in which the
14property is located a written notice to that effect describing
15the property, stating the date of the sale and specifying the
16extended period of redemption. Upon receiving the notice, the
17county clerk shall write or stamp the date of receipt upon the
18notice. The county clerk shall not be required to extend the
19period of redemption unless the purchaser or his or her
20assignee obtains this acknowledgement of delivery. If prior to
21the expiration of the period of redemption or extended period
22of redemption a petition for tax deed has been filed under
23Section 22-30, upon application of the petitioner, the court
24shall allow the purchaser or his or her assignee to extend the
25period of redemption after expiration of the original period or

1any extended period of redemption, provided that any extension
2allowed will expire not later than 3 years from the date of
3sale. If the period of redemption is extended, the purchaser or
4his or her assignee must give the notices provided for in
5Section 22-10 at the specified times prior to the expiration of
6the extended period of redemption by causing a sheriff (or if
7he or she is disqualified, a coroner) of the county in which
8the property, or any part thereof, is located to serve the
9notices as provided in Sections 22-15 and 22-20. The notices
10may also be served as provided in Sections 22-15 and 22-20 by a
11special process server appointed by the court under Section
1222-15.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
