| 2 | | AMENDMENT NO. ______. Amend House Bill 4988 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Environmental Protection Act is amended by | 5 | | adding Section 19.11 as follows: | 6 | | (415 ILCS 5/19.11 new) | 7 | | Sec. 19.11. Public water supply disruption; notification. | 8 | | (a) In this Section: | 9 | | "Disruption event" means any: | 10 | | (1) change to a disinfection technique, practice, or | 11 | | technology that could change disinfectant levels in the | 12 | | water within a public water supply; | 13 | | (2) planned or unplanned work on or damage to a water | 14 | | main; | 15 | | (3) change in a treatment application or source of | 16 | | water that results in an altered finished water quality; |

| 1 | | (4) event that results in a public water supply's | 2 | | operating pressure falling below 20 PSI; or | 3 | | (5) condition that results in the issuance of a boil | 4 | | water order. | 5 | | "Disruption event" includes, but
is not limited to, any | 6 | | water main break, system failure or
disruption, equipment | 7 | | failure, chemical or disinfectant
treatment interruption, or | 8 | | flooding of a public water supply operator's facilities. | 9 | | "Health care facility" means a facility, hospital, or | 10 | | establishment licensed or organized under the Ambulatory | 11 | | Surgical Treatment Center Act, the University of Illinois | 12 | | Hospital Act, the Hospital Licensing Act, the Nursing Home | 13 | | Care Act, the Assisted Living and Shared Housing Act, or the | 14 | | Community Living Facilities Licensing Act. | 15 | | "Health care facility list" means a list enumerating | 16 | | health care facilities and their designees that are served by | 17 | | a public water supply and maintained by a public water supply | 18 | | operator. | 19 | | "Public water supply" has the same meaning as defined in | 20 | | Section 3.365. | 21 | | "Public water supply operator" means any of the following | 22 | | entities that are responsible for the direct supervision of a | 23 | | public water supply: a municipality, a private corporation, an | 24 | | individual private owner, or a regularly organized body | 25 | | governed by a constitution and by-laws requiring regular | 26 | | election of officers. |

| 1 | | "State agencies" means the Illinois Environmental | 2 | | Protection Agency and the Illinois Department of Public | 3 | | Health. | 4 | | "Water supply operator" means any individual trained in | 5 | | the treatment
or distribution of water who has practical, | 6 | | working knowledge of the chemical,
biological, and physical | 7 | | sciences essential to the practical mechanics
of water | 8 | | treatment or distribution and who is capable of conducting
and | 9 | | maintaining the water treatment or distribution processes of a | 10 | | public water supply,
as defined in Section 3.365 of the | 11 | | Environmental Protection Act, in a
manner that will provide | 12 | | safe, potable water for human consumption. | 13 | | (b) A public water supply operator, through its designated | 14 | | employees or contractors, shall notify its public water supply | 15 | | operator and all health care facilities on the public water | 16 | | supply's health care facility list not more than 30 days or | 17 | | fewer than 15 days before any known, planned, or anticipated | 18 | | disruption event. An anticipated disruption event includes for | 19 | | purposes of this subsection (b) any disruption event that | 20 | | could or should be reasonably anticipated by a public water | 21 | | supply operator. | 22 | | (c) A public water supply operator, through its designated | 23 | | employees or contractors, shall notify its water supply | 24 | | operator and all health care facilities that are served by the | 25 | | public water supply and affected by any unplanned disruption | 26 | | event in the public water supply's water distribution system. |

| 1 | | The notification required under this subsection (c) shall be | 2 | | provided within 2 hours after the public water supply operator | 3 | | becomes aware of the unplanned disruption event. | 4 | | (d) A health care facility shall designate an email | 5 | | address to receive electronic notifications from the public | 6 | | water supply operator concerning planned or unplanned | 7 | | disruption events. The email account shall be accessible to | 8 | | the health care facility's designated water management plan | 9 | | administrator and other responsible administrative personnel. | 10 | | (e) Any planned or unplanned disruption event notification | 11 | | sent to a health care facility under this Section shall also be | 12 | | sent to the State agencies within 5 business days. | 13 | | Notification shall also be posted on the public water supply | 14 | | operator's website that is accessible to the public if such a | 15 | | website existed as of January 1, 2022. A public water supply | 16 | | operator may provide notification to its customers and the | 17 | | public on a social media website rather than posting the | 18 | | required notice on its website if (1) the public water supply | 19 | | operator uses the social media website to regularly | 20 | | communicate with its customers; (2) the social media website | 21 | | is accessible to the general public; and (3) the social media | 22 | | website's use will reduce the timeframe for customer | 23 | | notification. The State agencies shall establish, maintain, | 24 | | and retain a list of notifications received pursuant to this | 25 | | subsection (e). | 26 | | The notice required under this Section shall include, but |

| 1 | | shall not be limited to, the following: | 2 | | (1) a detailed description of the disruption event; | 3 | | (2) the date, time, and location of the disruption | 4 | | event; | 5 | | (3) the expected time needed to resolve the disruption | 6 | | event; and | 7 | | (4) a list of the health care facilities notified by | 8 | | the public
water supply operator. | 9 | | Beginning one year after the effective date of this | 10 | | amendatory Act of the 102nd General Assembly, the State | 11 | | agencies shall make
available upon request a list of | 12 | | disruption events, in an electronic format, sorted by the year | 13 | | and month of each occurrence.
| 14 | | Section 99. Effective date. This Act takes effect upon | 15 | | becoming law.".
