AMENDMENT TO SENATE BILL 2342

2    AMENDMENT NO. ______. Amend Senate Bill 2342 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Lottery Law is amended by
5changing Section 7.12 as follows:
 
6    (20 ILCS 1605/7.12)
7    (Section scheduled to be repealed on July 1, 2022)
8    Sec. 7.12. Internet program.
9    (a) The General Assembly finds that:
10        (1) the consumer market in Illinois has changed since
11    the creation of the Illinois State Lottery in 1974;
12        (2) the Internet has become an integral part of
13    everyday life for a significant number of Illinois
14    residents not only in regards to their professional life,
15    but also in regards to personal business and
16    communication; and

1        (3) the current practices of selling lottery tickets
2    does not appeal to the new form of market participants who
3    prefer to make purchases on the Internet at their own
4    convenience.
5    It is the intent of the General Assembly to create an
6Internet program for the sale of lottery tickets to capture
7this new form of market participant.
8    (b) The Department shall create a program that allows an
9individual 18 years of age or older to purchase lottery
10tickets or shares on the Internet without using a Lottery
11retailer with on-line status, as those terms are defined by
12rule. The Department shall restrict the sale of lottery
13tickets on the Internet to transactions initiated and received
14or otherwise made exclusively within the State of Illinois.
15The Department shall adopt rules necessary for the
16administration of this program. These rules shall include,
17among other things, requirements for marketing of the Lottery
18to infrequent players, as well as limitations on the purchases
19that may be made through any one individual's lottery account.
20The provisions of this Act and the rules adopted under this Act
21shall apply to the sale of lottery tickets or shares under this
22program.
23    The Department is obligated to implement the program set
24forth in this Section and Sections 7.15 and 7.16. The
25Department may offer Lotto, Lucky Day Lotto, Mega Millions,
26Powerball, Pick 3, Pick 4, and other draw games that are

1offered at retail locations, as well as interactive instant
2win games, through the Internet program. The private manager
3shall obtain the Director's approval before providing any draw
4games or commencing the interactive instant win games program.
5When the Department or the private manager offers interactive
6instant win games through the Internet pilot program, the
7Department or the private manager shall make these games
8available for sale at retail locations by a lottery licensee
9pursuant to the Department's rules to concurrently enhance the
10Lottery's revenue growth from retail sales. The Department or
11the private manager shall offer interactive instant win games
12through the Internet pilot program only at retail locations
13for 6 months after the initial launch date. As used in this
14Section, "interactive instant win game" means a virtual
15Lottery instant game ticket with specified prize structures
16and set odds. Any draw game tickets that are approved for sale
17by lottery licensees are automatically approved for sale
18through the Internet program. The Department shall maintain
19responsible gaming controls in its policies.
20    The Department shall authorize the private manager to
21implement and administer the program pursuant to the
22management agreement entered into under Section 9.1 and in a
23manner consistent with the provisions of this Section. If a
24private manager has not been selected pursuant to Section 9.1
25at the time the Department is obligated to implement the
26program, then the Department shall not proceed with the

1program until after the selection of the private manager, at
2which time the Department shall authorize the private manager
3to implement and administer the program pursuant to the
4management agreement entered into under Section 9.1 and in a
5manner consistent with the provisions of this Section.
6    Nothing in this Section shall be construed as prohibiting
7the Department from implementing and operating a website
8portal whereby individuals who are 18 years of age or older
9with an Illinois mailing address may apply to purchase lottery
10tickets via subscription. Nothing in this Section shall also
11be construed as prohibiting the Lottery draw game tickets or
12interactive instant win games authorized for sale through the
13Internet program under this Section from also continuing to be
14sold at retail locations by a lottery licensee pursuant to the
15Department's rules.
16    (c) (Blank).
17    (d) This Section is repealed on July 1, 2022.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
