AMENDMENT TO HOUSE BILL 3144

2    AMENDMENT NO. ______. Amend House Bill 3144, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 2, by replacing line 9 on page 124 through line 17 on page
5125 with the following:
 
6    "(35 ILCS 120/2-27)
7    Sec. 2-27. Prepaid telephone calling arrangements.
8"Prepaid telephone calling arrangements" mean the right to
9exclusively purchase telephone or telecommunications services
10that must be paid for in advance and enable the origination of
11one or more intrastate, interstate, or international telephone
12calls or other telecommunications using an access number, an
13authorization code, or both, whether manually or
14electronically dialed, for which payment to a retailer must be
15made in advance, provided that, unless recharged, no further
16service is provided once that prepaid amount of service has
17been consumed, and provided further that, on and after January

11, 2025, the telephone or telecommunications services included
2in such arrangement are obtained through the purchase of a
3preloaded phone, calling card, or other item of tangible
4personal property. Prepaid telephone calling arrangements
5include the recharge of a prepaid calling arrangement if and
6only if, on and after January 1, 2025, the additional
7telephone or telecommunications services included in the
8recharge are obtained through the purchase of a preloaded
9phone, calling card, or other item of tangible personal
10property. For purposes of this Section, "recharge" means the
11purchase of additional prepaid telephone or telecommunications
12services whether or not the purchaser acquires a different
13access number or authorization code. For purposes of this
14Section, "telecommunications" means that term as defined in
15Section 2 of the Telecommunications Excise Tax Act. "Prepaid
16telephone calling arrangement" does not include an arrangement
17whereby the service provider reflects the amount of the
18purchase as a credit on an account for a customer under an
19existing subscription plan, nor, on and after January 1, 2025,
20does it include a recharge that is not obtained through the
21purchase of a preloaded phone, calling card, or other item of
22tangible personal property.

24on page 136, line 22, after the period, by inserting "Within 10
25days after receipt by the Comptroller of the disbursement

1certification to the counties provided for in this Section to
2be given to the Comptroller by the Department, the Comptroller
3shall cause the orders to be drawn for the amounts in
4accordance with the directions contained in the
5certification."; and
 
6on page 160, line 8, after the period, by inserting "Within 10
7days after receipt by the Comptroller of the disbursement
8certification to the municipalities provided for in this
9Section to be given to the Comptroller by the Department, the
10Comptroller shall cause the orders to be drawn for the amounts
11in accordance with the directions contained in the
12certification.".
