AMENDMENT TO HOUSE BILL 3508

2    AMENDMENT NO. ______. Amend House Bill 3508 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The PFAS Reduction Act is amended by adding
5Section 40 as follows:
 
6    (415 ILCS 170/40 new)
7    Sec. 40. Guidance from United States Environmental
8Protection Agency; PFAS monitoring plan; technical assistance.
9    (a) The Agency shall follow the most up-to-date guidance
10to states from the United States Environmental Protection
11Agency on addressing the discharge of PFAS in National
12Pollutant Discharge Elimination System (NPDES) permits;
13however, the Agency shall not require monitoring for PFAS in
14influent, effluent, and biosolids to commence less than 30
15days after the United States Environmental Protection Agency
16adopts an approved method for analyzing PFAS in these

1matrices. Monitoring required under NPDES permits shall be
2limited to those specific PFAS compounds for which an
3analytical method has been approved by the United States
4Environmental Protection Agency.
5    (b) The Agency shall create a PFAS monitoring plan. The
6plan shall focus on the following:
7        (1) monitoring PFAS occurrence in wastewater flows
8    from industrial and domestic sources, stormwater
9    discharges, and solid waste streams;
10        (2) gathering State-specific information in order to
11    craft effective policies to address PFAS occurrence in
12    wastewater, stormwater, and solid waste; and
13        (3) gathering data to inform PFAS source reduction and
14    pollution prevention programs, including, but not limited
15    to, industrial pretreatment programs administered by
16    publicly owned treatment works.
17    The plan shall be submitted to the Governor and the
18General Assembly by July 1, 2024.
19    (c) The Prairie Research Institute's Illinois Sustainable
20Technology Center shall provide technical assistance to
21industrial wastewater dischargers in best management
22practices, pollution prevention, production substitution, and
23elimination to reduce or eliminate PFAS compounds.".
