| 1 | | AN ACT concerning civil law.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Adoption Act is amended by changing Section | 5 | | 18.4 as follows:
| 6 | | (750 ILCS 50/18.4) (from Ch. 40, par. 1522.4)
| 7 | | Sec. 18.4.
(a) The agency, Department of Children and | 8 | | Family Services,
Court Supportive Services, Juvenile Division | 9 | | of the Circuit Court, or the
Probation Officers of the Circuit | 10 | | Court involved in the adoption
proceedings shall give in | 11 | | writing the following non-identifying
information, if known, | 12 | | to
the adoptive parents not later than the date of placement | 13 | | with the
petitioning adoptive parents: (i) age of biological | 14 | | parents; (ii) their race,
religion and ethnic background; (iii) | 15 | | general physical appearance of
biological parents; (iv) their | 16 | | education, occupation, hobbies, interests
and talents; (v) | 17 | | existence of any other children born to the biological
parents; | 18 | | (vi) information about biological grandparents; reason for
| 19 | | emigrating into the United States, if applicable, and country | 20 | | of origin;
(vii) relationship between biological parents; | 21 | | (viii) detailed
medical and mental health histories of the | 22 | | child, the
biological parents, and their immediate relatives; | 23 | | and (ix) the actual date
and place of birth of the adopted |

| 1 | | person ; and (x) the reason or reasons the birth parent or | 2 | | parents stated for placing the child for adoption, how and why | 3 | | the adoptive parent or parents were selected and who selected | 4 | | the adoptive parent or parents, and whether the birth parent or | 5 | | parents requested or agreed to post-adoption contact with the | 6 | | child at the time of placement, and, if so, the frequency and | 7 | | type of contact . However,
no information provided under this | 8 | | subsection shall disclose
the name or last known address of the | 9 | | biological parents, grandparents, the
siblings of the | 10 | | biological parents, the adopted person, or any other
relative | 11 | | of the adopted person.
| 12 | | (b) Any adoptee 18 years of age or over shall be given the
| 13 | | information in subsection (a) upon request.
| 14 | | (c) The Illinois Adoption Registry shall release any | 15 | | non-identifying
information listed in (a) of this Section that | 16 | | appears on the certified copy of
the original
birth certificate | 17 | | or the Certificate of Adoption to an adopted person,
adoptive | 18 | | parent, or legal guardian who is a registrant of the Illinois
| 19 | | Adoption Registry.
| 20 | | (d) The Illinois Adoption Registry shall release the actual | 21 | | date
and place of birth of an adopted person who is 21 years of | 22 | | age or over
to the birth
parent if the birth parent is a | 23 | | registrant of the Illinois Adoption
Registry and has completed | 24 | | a Medical Information Exchange
Authorization.
| 25 | | (e) The Illinois Adoption Registry shall release | 26 | | information
regarding the date the adoption was finalized and |

| 1 | | the county in which the
adoption
was finalized to a certified | 2 | | confidential intermediary upon submission
of a court order.
| 3 | | (f) In cases where the Illinois Adoption Registry possesses
| 4 | | information indicating that an adopted person who is 21 years | 5 | | of age or over
was
adopted in a state other than Illinois or a | 6 | | country other than the
United States, the Illinois Adoption | 7 | | Registry shall release the name of
the state or country where | 8 | | the adoption was finalized and, if
available, the agency | 9 | | involved in the adoption to a registrant of the
Illinois | 10 | | Adoption Registry, provided the registrant is not the subject | 11 | | of a
Denial of Information Exchange and the registrant has | 12 | | completed a Medical
Information
Exchange Authorization.
| 13 | | (g) Any of the above available information for any adoption
| 14 | | proceedings
completed before the effective date of this Act | 15 | | shall be supplied to the
adoptive parents or an adoptee 18 | 16 | | years of age or over upon request.
| 17 | | (h) The agency, Department of Children and Family Services,
| 18 | | Court
Supportive Services, Juvenile Division of the Circuit | 19 | | Court, the Probation
Officers of the Circuit Court and any | 20 | | other governmental bodies having any
of the above information | 21 | | shall retain the file until the adoptee would
have reached the | 22 | | age of 99 years.
