| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the State | 5 | | Vehicle Use Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Constitutional officers" means the officers created under | 8 | | Article V of the Illinois Constitution. | 9 | | "Department" means the Department of Central Management | 10 | | Services. | 11 | | "Division of Vehicles" means the Division of Vehicles | 12 | | within the Department of Central Management Services. | 13 | | "State agency" means all departments, officers, | 14 | | commissions, boards, institutions, and bodies politic and | 15 | | corporate of the State. "State agency" does not include the | 16 | | judicial branch, including, without limitation, the several | 17 | | courts of the State, the offices of the clerk of the supreme | 18 | | court and the clerks of the appellate court, and the | 19 | | Administrative Office of the Illinois Courts, the legislature | 20 | | or its committees or commissions, or units of local government. | 21 | | "Vehicle" means any motor vehicle belonging to the State of | 22 | | Illinois or any agency, board, commission, branch, or | 23 | | department thereof or controlled thereby, including |

| 1 | | automobiles, motorcycles, trucks, and other types of | 2 | | automotive equipment. | 3 | | Section 10. Vehicle use officer; vehicle use policy. | 4 | | (a) Each State agency shall designate a vehicle use officer | 5 | | to monitor the use of State-owned vehicles by that State | 6 | | agency. | 7 | | (b) Each State agency, with the assistance of the vehicle | 8 | | use officer, shall draft a vehicle use policy. All vehicle use | 9 | | policies, other than those drafted by a constitutional officer, | 10 | | shall be submitted to the Division of Vehicles within the | 11 | | Department of Central Management Services and shall be made | 12 | | publicly available on the Department's official Internet | 13 | | website. A vehicle use officer for a constitutional officer | 14 | | shall make the vehicle use policy publicly available on the | 15 | | constitutional officer's official Internet website. A vehicle | 16 | | use policy shall include the following: | 17 | | (1) a policy concerning take-home vehicles, including | 18 | | requirements for emergency use of take-home vehicles and | 19 | | restrictions on the use of take-home vehicles solely for | 20 | | commuting; and | 21 | | (2) procedures regarding daily vehicle use logs and | 22 | | mileage recording. | 23 | | Section 20. Mileage reimbursement. For cases in which a | 24 | | State employee would otherwise use a State-owned vehicle but |

| 1 | | uses his or her own vehicle instead, a State agency may | 2 | | reimburse a State employee for automobile travel expenses in | 3 | | accordance with the State Travel Regulations and Reimbursement | 4 | | Rates adopted under Section 12-2 of the State Finance Act. | 5 | | Section 25. The Department of Central Management Services | 6 | | Law of the
Civil Administrative Code of Illinois is amended by | 7 | | changing Section 405-280 as follows:

| 9 | | Sec. 405-280. State garages; passenger cars. | 10 | | (a) To supervise and
administer all State garages used for
| 11 | | the repair, maintenance, or servicing of State-owned motor | 12 | | vehicles
except those operated by any State college or | 13 | | university or by the Illinois
Mathematics and Science Academy; | 14 | | and to acquire, maintain, and administer
the operation of the | 15 | | passenger cars reasonably necessary to the operations
of the | 16 | | executive department of the State government. To this end, the
| 17 | | Department shall adopt regulations setting
forth guidelines | 18 | | for the acquisition, use, maintenance, and replacement of
motor | 19 | | vehicles, including the use of ethanol blended gasoline | 20 | | whenever
feasible, used by the executive department of State | 21 | | government;
shall
occupy the space and take possession of the | 22 | | personnel, facilities,
equipment, tools, and vehicles that are | 23 | | in the possession or
under the
administration of the former | 24 | | Department of Administrative Services for these
purposes on |

| 1 | | July 13, 1982 (the effective date of Public Act 82-789); and | 2 | | shall,
from time to time, acquire any further, additional, and
| 3 | | replacement
facilities, space, tools, and vehicles that are | 4 | | reasonably
necessary for
the purposes described in this | 5 | | Section. | 6 | | (b) The Department shall evaluate the availability and cost | 7 | | of GPS systems that State agencies may be able to use to track | 8 | | State-owned motor vehicles. | 9 | | (c) The Department shall distribute a spreadsheet or | 10 | | otherwise make data entry available to each State agency to | 11 | | facilitate the collection of data for publishing on the | 12 | | Department's Internet website. Each State agency shall | 13 | | cooperate with the Department in furnishing the data necessary | 14 | | for the implementation of this subsection within the timeframe | 15 | | specified by the Department. Each State agency shall be | 16 | | responsible for the validity and accuracy of the data provided. | 17 | | Beginning on July 1, 2013, the Department shall make available | 18 | | to the public on its Internet website the following | 19 | | information: | 20 | | (1) vehicle cost data, organized by individual vehicle | 21 | | and by State agency, and including repair, maintenance, | 22 | | fuel, insurance, and other costs, as well as whether | 23 | | required vehicle inspections have been performed; and | 24 | | (2) an annual vehicle breakeven analysis, organized by | 25 | | individual vehicle and by State agency, comparing the | 26 | | number of miles a vehicle has been driven with the total |

| 1 | | cost of maintaining the vehicle. | 2 | | (d) Beginning on the effective date of this amendatory Act | 3 | | of the 97th General Assembly, and notwithstanding any provision | 4 | | of law to the contrary, the Department may not make any new | 5 | | motor vehicle purchases until the Department sets forth | 6 | | procedures to condition the purchase of new motor vehicles on | 7 | | (i) a determination of need based on a breakeven analysis, and | 8 | | (ii) a determination that no other available means, including | 9 | | car sharing or rental agreements, would be more cost-effective | 10 | | to the State. However, the Department may purchase motor | 11 | | vehicles not meeting or exceeding a breakeven analysis only if | 12 | | there is no alternative available to carry out agency work | 13 | | functions and the purchase is approved by the Manager of the | 14 | | Division of Vehicles upon the receipt of a written explanation | 15 | | from the agency head of the operational needs justifying the | 16 | | purchase.
