          Amends the Legislative  Materials  Act.   Authorizes  the
      Clerk  of the House, to the extent authorized by House Rules,
      to establish a schedule of reasonable fees to be  charged  to
      members  for  the  preparation,  filing,  and reproduction of
      non-substantive resolutions.   Amends  the  General  Assembly
      Compensation  Act to authorize members to pay resolution fees
      from their office allowances.  Effective immediately.

 1        AN ACT concerning the General Assembly.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.   The Legislative Materials Act is amended by
 5    changing Section 1 as follows:
 6        (25 ILCS 105/1) (from Ch. 63, par. 801)
 7        Sec. 1. Fees.
 8        (a)  The  Clerk  of  the  House  of  Representatives  may
 9    establish a schedule of reasonable fees  to  be  charged  for
10    providing  copies  of  daily  and  bound  journals, committee
11    documents,  committee   tape   recordings,   transcripts   of
12    committee  proceedings,  and committee notices, for providing
13    copies of bills on a continuing or individual basis, and  for
14    providing  tape  recordings  and transcripts of floor debates
15    and other proceedings of the House.
16        (b)  The Secretary of the Senate may establish a schedule
17    of reasonable fees to be  charged  for  providing  copies  of
18    daily  and  bound  journals, committee notices, for providing
19    copies of bills on a continuing or individual basis, and  for
20    providing  tape  recordings  and transcripts of floor debates
21    and other proceedings of the Senate.
22        (c)  The Clerk of the House of  Representatives  and  the
23    Secretary   of   the  Senate  may  establish  a  schedule  of
24    reasonable fees to be charged for  providing  live  audio  of
25    floor   debates   and  other  proceedings  of  the  House  of
26    Representatives and the Senate.  The Clerk and the  Secretary
27    shall  have complete discretion over the distribution of live
28    audio under this subsection (c),  including  discretion  over
29    the  conditions  under which live audio shall be distributed,
30    except that live audio shall be distributed  to  the  General
31    Assembly  and  its  staffs.   Nothing  in this subsection (c)

 1    shall be construed to create an obligation on the part of the
 2    Clerk or Secretary to provide live audio  to  any  person  or
 3    entity other than to the General Assembly and its staffs.
 4        (c-5)  The  Clerk of the House of Representatives, to the
 5    extent  authorized  by  the  House  Rules,  may  establish  a
 6    schedule of reasonable fees to be charged to members for  the
 7    preparation,  filing,  and  reproduction  of  non-substantive
 8    resolutions.
 9        (d)  Receipts from all fees established under subsections
10    (a),  (b), and (c), and (c-5) shall be deposited by the Clerk
11    and  the  Secretary  into  the  General  Assembly  Operations
12    Revolving Fund, a special fund in the State treasury. Amounts
13    in the Fund may be appropriated for  the  operations  of  the
14    offices  of the Clerk of the House of Representatives and the
15    Secretary of the Senate.

17        Section 10.  The General  Assembly  Compensation  Act  is
18    amended by changing Section 4 as follows:

20        Sec.  4.  Office allowance.  Beginning July 1, 1989, each
21    member of the  House  of  Representatives  is  authorized  to
22    approve  the expenditure of not more than $57,000 $47,000 per
23    year and each member of the Senate is authorized  to  approve
24    the  expenditure of not more than $67,000 $57,000 per year to
25    pay  for   "personal   services",   "contractual   services",
26    "commodities", "printing", "travel", "operation of automotive
27    equipment",  "telecommunications services", as defined in the
28    State Finance Act,  and  the  compensation  of  one  or  more
29    legislative  assistants  authorized pursuant to this Section,
30    in connection with his or her legislative duties and  not  in
31    connection   with  any  political  campaign.   A  member  may
32    purchase office equipment if  the  member  certifies  to  the

 1    Secretary  of  the  Senate  or  the  Clerk  of  the House, as
 2    applicable, that the purchase price, whether paid in lump sum
 3    or installments, amounts to less than would  be  charged  for
 4    renting  or leasing the equipment over its anticipated useful
 5    life.  All such  equipment  must  be  purchased  through  the
 6    Secretary  of  the  Senate  or  the  Clerk  of  the House, as
 7    applicable, for proper  identification  and  verification  of
 8    purchase.
 9        Each  member  of  the  General  Assembly is authorized to
10    employ one or  more  legislative  assistants,  who  shall  be
11    solely  under  the  direction and control of that member, for
12    the purpose of assisting the member in the performance of his
13    or her official  duties.   A  legislative  assistant  may  be
14    employed pursuant to this Section either under contract or as
15    a  State  employee,  at  the  discretion  of  the  member. If
16    employed as a State employee, a legislative  assistant  shall
17    receive  employment benefits on the same terms and conditions
18    that apply to other employees of the General Assembly.
19        As used in this  Section  the  term  "personal  services"
20    shall  include  contributions  of the State under the Federal
21    Insurance Contribution  Act  and  under  Article  14  of  the
22    Illinois   Pension   Code.   As  used  in  this  Section  the
23    term"contractual services" shall not include improvements  to
24    real property unless those improvements are the obligation of
25    the lessee under the lease agreement. Beginning July 1, 1989,
26    as used in the Section, the term "travel" shall be limited to
27    travel  in  connection with a member's legislative duties and
28    not in connection with  any  political  campaign.   Beginning
29    July  1,  1989,  as used in this Section, the term "printing"
30    includes congratulatory mailings, including but  not  limited
31    to  greeting  or  welcome  messages,  anniversary or birthday
32    cards, and congratulations for prominent  achievement  cards.
33    As  used  in  this Section, the term "printing" includes fees
34    for non-substantive resolutions charged by the Clerk  of  the

 1    House  of Representatives under subsection (c-5) of Section 1
 2    of the Legislative Materials Act.  Nothing  in  this  Section
 3    shall  be construed to authorize expenditures for lodging and
 4    meals while a member is in  attendance  at  sessions  of  the
 5    General Assembly.
 6        Any  utility  bill  for  service  provided  to a member's
 7    district  office  for  a  period  including  portions  of   2
 8    consecutive  fiscal years may be paid from funds appropriated
 9    for such expenditure in either fiscal year.
10        If  a  vacancy  occurs  in  the  office  of  Senator   or
11    Representative  in the General Assembly, any office equipment
12    in the possession of the vacating member  shall  transfer  to
13    the  member's  successor; if the successor does not want such
14    equipment, it shall be transferred to the  Secretary  of  the
15    Senate  or Clerk of the House of Representatives, as the case
16    may be, and if not wanted by other  members  of  the  General
17    Assembly   then  to  the  Department  of  Central  Management
18    Services for treatment as surplus property  under  the  State
19    Property  Control Act. Each member, on or before June 30th of
20    each year,  shall  conduct  an  inventory  of  all  equipment
21    purchased  pursuant  to  this  Act.   Such inventory shall be
22    filed with the Secretary of the Senate or the  Clerk  of  the
23    House,  as  the  case  may be. Whenever a vacancy occurs, the
24    Secretary of the Senate or the Clerk of  the  House,  as  the
25    case   may  be,  shall  conduct  an  inventory  of  equipment
26    purchased.
27        In the event that a member leaves office  during  his  or
28    her  term,  any  unexpended  or  unobligated  portion  of the
29    allowance  granted  under  this  Section  shall  lapse.   The
30    vacating member's successor shall be granted an allowance  in
31    an  amount,  rounded  to  the  nearest  dollar,  computed  by
32    dividing  the  annual  allowance  by  365 and multiplying the
33    quotient by the number of days remaining in the fiscal year.
34        From any appropriation for the purposes of  this  Section

 1    for  a  fiscal  year  which overlaps 2 General Assemblies, no
 2    more than 1/2 of the annual allowance per member may be spent
 3    or encumbered  by  any  member  of  either  the  outgoing  or
 4    incoming  General  Assembly,  except  that  any member of the
 5    incoming General Assembly who was a member  of  the  outgoing
 6    General  Assembly  may  encumber  or spend any portion of his
 7    annual allowance within the fiscal year.
 8        The appropriation for the annual allowances permitted  by
 9    this  Section  shall  be  included in an appropriation to the
10    President of the Senate and to the Speaker of  the  House  of
11    Representatives  for their respective members.  The President
12    of the Senate and the Speaker of the House shall voucher  for
13    payment  individual  members'  expenditures from their annual
14    office allowances to the State Comptroller,  subject  to  the
15    authority  of  the  Comptroller  under Section 9 of the State
16    Comptroller Act.

18        Section 15.  The State Paper Purchasing Act is amended by
19    changing Sections 1 and 11 as follows:
20        (30 ILCS 510/1) (from Ch. 127, par. 132.101)
21        Sec.  1.   As  used  in  this  Act,  unless  the  context
22    otherwise requires:  "Department"  means  the  Department  of
23    Central Management Services.
24        "Envelopes"   means   covers   which  are  fabricated  or
25    manufactured from paper and are suitable for, or  similar  in
26    form  to  items  suitable  for, use in transmitting materials
27    through the mails. It does not include paper boxes.
28        "Printing paper" and "letter paper" means paper  that  is
29    normally  used  in mechanical or manual printing, duplicating
30    or writing, where the principal function or  purpose  of  the
31    resulting  product  is  primarily dependent on the printed or
32    written content.

 1        "State agency" means  and  includes  any  State  officer,
 2    department,   institution,   hospital,  penitentiary,  board,
 3    bureau, commission or other administrative unit of the  State
 4    government,  but does not include the General Assembly or any
 5    of the legislative support services  agencies,  the  Illinois
 6    Mathematics  and Science Academy, the University of Illinois,
 7    Southern  Illinois  University,  Chicago  State   University,
 8    Eastern  Illinois  University,  Governors  State  University,
 9    Illinois  State University, Northeastern Illinois University,
10    Northern Illinois University, or Western Illinois University.
11        This amendatory Act of 1997 is  declarative  of  existing
12    law and restates the intent of Public Acts 83-1257 and 88-535
13    that the General Assembly controls all aspects of legislative
14    printing operations and the acquisition of related supplies.
15        "Stationery" means letter paper.

18        Sec.  11. No State agency may purchase an item covered by
19    this Act without the prior written approval of the Department
20    stating that the terms of the purchase  are  consistent  with
21    this Act.
22        The General Assembly and the legislative support services
23    agencies may, but are not required to, purchase items covered
24    by this Act in accordance with its provisions.

26        Section  99.  Effective date.  This Act takes effect upon
27    becoming law.
