      110 ILCS 805/2-11.5
          Amends the Public Community College Act and the  Illinois
      State  University Law.  Effective July 1, 1997, abolishes the
      Illinois Institute for Entrepreneurship Education as  created
      and  functioning within the Illinois Community College Board,
      terminates the terms of its 18 member  Board,  and  recreates
      the  Institute,  as a successor to the predecessor Institute,
      with a new 15 member Board within Illinois State  University.
      Provides  for  transfer  of  all powers, duties, records, and
      property  of  the  predecessor  Institute  to  the  successor
      Institute as of July 1, 1997.  Effective immediately.

 1        AN ACT relating to higher education, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  2.  The Board of Higher Education Act is amended
 5    by changing Section 4 as follows:
 6        (110 ILCS 205/4) (from Ch. 144, par. 184)
 7        Sec. 4. The Board shall hold regular  meetings  at  times
 8    specified  in  its rules.  Special or additional meetings may
 9    be held on call of the Chairman, or upon a call signed by  at
10    least  6 members, or upon call of the Governor. A majority of
11    the members of the Board shall constitute a quorum at all its
12    meetings, but the approval of  a  new  unit  of  instruction,
13    research,  or  public  service  for  a  public institution of
14    higher education, as provided in Section 7 shall require  the
15    concurrence of a majority of all the members of the Board.
16        The  Chairmen of the Illinois Community College Board and
17    the Illinois Student Assistance Commission holding membership
18    on the Board each may designate an alternate  to  attend  any
19    meeting  of  the  Board, and an alternate so designated shall
20    have all rights and privileges of  regular  membership  while
21    acting for the Chairman who has so designated him or her.
22        The   Board  may  employ  and  fix  the  compensation  of
23    professional  and  clerical  staff  and   other   assistants,
24    including   specialists  and  consultants,  as  it  may  deem
25    necessary, on a full or part time basis.

27        Section 5.  The Illinois State University Law is  amended
28    by adding Section 20-115 as follows:

 1        Sec.  20-115.  Illinois  Institute  for  Entrepreneurship
 2    Education.
 3        (a)  There is created, effective July 1, 1997, within the
 4    State  at  Illinois  State University, the Illinois Institute
 5    for Entrepreneurship Education, hereinafter  referred  to  as
 6    the Institute.
 7        (b)  The  Institute  created  under  this  Section  shall
 8    commence  its  operations  on  July  1, 1997 and shall have a
 9    board composed of 15  members  representative  of  education,
10    commerce  and  industry,  government,  or labor, appointed as
11    follows: 2 members shall be appointees of the  Governor,  one
12    of  whom  shall  be a minority or female person as defined in
13    Section 2 of the Business Enterprise for Minorities, Females,
14    and Persons with Disabilities Act; one  member  shall  be  an
15    appointee of the President of the Senate; one member shall be
16    an  appointee  of  the  Minority  Leader  of the Senate;  one
17    member shall be an appointee of the Speaker of the  House  of
18    Representatives;  one  member  shall  be  an appointee of the
19    Minority Leader of the House of Representatives;   2  members
20    shall  be appointees of Illinois State University; one member
21    shall be an appointee of the Board of Higher  Education;  one
22    member shall be an appointee of the State Board of Education;
23    one  member  shall  be  an  appointee  of  the  Department of
24    Commerce and  Community  Affairs;  one  member  shall  be  an
25    appointee of the Illinois chapter of Economics America; and 3
26    members  shall  be appointed by majority vote of the other 12
27    appointed members to represent business  owner-entrepreneurs.
28    Each  member  shall have expertise and experience in the area
29    of entrepreneurship education, including small  business  and
30    entrepreneurship.   The  majority  of  voting members must be
31    from the private sector. The members initially  appointed  to
32    the  board  of the Institute created under this Section shall
33    be appointed to take office on July 1, 1997 and shall by  lot
34    determine  the length of their respective terms as follows: 5

 1    members shall be selected by lot to serve terms of one  year,
 2    5 members shall be selected by lot to serve terms of 2 years,
 3    and  5  members  shall be selected by lot to serve terms of 3
 4    years. Subsequent appointees shall  each  serve  terms  of  3
 5    years.  The  board  shall  annually select a chairperson from
 6    among its members.  Each board member  shall  serve   without
 7    compensation but shall be reimbursed for expenses incurred in
 8    the performance of his or her duties.
 9        (c)  The  purpose of the Institute shall be to foster the
10    growth and development of entrepreneurship education  in  the
11    State  of  Illinois.   The  Institute  shall  help remedy the
12    deficiencies in the preparation of entrepreneurship education
13    teachers,   increase   the   quality    and    quantity    of
14    entrepreneurship  education  programs,  improve instructional
15    materials, and prepare personnel  to  serve  as  leaders  and
16    consultants  in  the  field of entrepreneurship education and
17    economic   development.    The   Institute   shall    promote
18    entrepreneurship  as a career option, promote and support the
19    development   of   innovative   entrepreneurship    education
20    materials  and  delivery systems, promote business, industry,
21    and  education  partnerships,   promote   collaboration   and
22    involvement in entrepreneurship education programs, encourage
23    and  support  in-service  and  preservice  teacher  education
24    programs  within various educational systems, and develop and
25    distribute relevant materials.  The Institute shall provide a
26    framework under which the public and private sectors may work
27    together  toward  entrepreneurship  education  goals.   These
28    goals shall be achieved by bringing  together  programs  that
29    have  an  impact  on  entrepreneurship  education  to achieve
30    coordination among agencies and  greater  efficiency  in  the
31    expenditure of funds.
32        (d)  Beginning July 1, 1997, the Institute shall have the
33    following   powers   subject  to  State  and  Illinois  State
34    University Board of Trustees regulations and guidelines:

 1             (1)  To employ and determine the compensation of  an
 2        executive director and such staff as it deems necessary;
 3             (2)  To  own  property  and expend and receive funds
 4        and generate funds;
 5             (3)  To  enter  into  agreements  with  public   and
 6        private entities in the furtherance of its purpose; and
 7             (4)  To  request  and  receive  the  cooperation and
 8        assistance of all State departments and agencies  in  the
 9        furtherance of its purpose.
10        (e)  The  board of the Institute shall be a policy making
11    body with the  responsibility  for  planning  and  developing
12    Institute  programs.  The  Institute,  through  the  Board of
13    Trustees of Illinois State University, shall annually  report
14    to  the Governor and General Assembly by January 31 as to its
15    activities  and  operations,  including  its   findings   and
16    recommendations.
17        (f)  Beginning  on  July  1,  1997, the Institute created
18    under this Section shall be deemed designated by law  as  the
19    successor  to  the  Illinois  Institute  for Entrepreneurship
20    Education, previously created and  existing  under    Section
21    2-11.5   of  the  Public  Community  College  Act  until  its
22    abolition on July 1, 1997 as provided in  that  Section.   On
23    July  1,  1997,  all  financial  and  other  records  of  the
24    Institute  so abolished and all of its property, whether real
25    or personal, including but not limited to all  inventory  and
26    equipment, shall be deemed transferred by operation of law to
27    the Illinois Institute for Entrepreneurship Education created
28    under  this  Section  20-115.   The  Illinois  Institute  for
29    Entrepreneurship  Education created under this Section 20-115
30    shall have, with respect  to  the  predecessor  Institute  so
31    abolished,  all  authority, powers, and duties of a successor
32    agency under Section 10-15 of the Successor Agency Act.

 1        Section 10.  The Public Community College Act is  amended
 2    by changing Section 2-11.5 as follows:
 3        (110 ILCS 805/2-11.5)
 4        Sec.  2-11.5.  Illinois  Institute  for  Entrepreneurship
 5    Education.
 6        (a)  There is created, effective July 1, 1996, within the
 7    State  and the Illinois Community College Board, the Illinois
 8    Institute   for   Entrepreneurship   Education,   hereinafter
 9    referred to as the Institute.
10        (b)  The  Institute  created  under  this  Section  shall
11    commence its operations on July 1,  1996  and  shall  have  a
12    board  composed  of  18  members representative of education,
13    commerce and industry, and government or labor, appointed  as
14    follows:  2  members shall be appointees of the Governor, one
15    of whom shall be a minority or female person  as  defined  in
16    Section 2 of the Business Enterprise for Minorities, Females,
17    and  Persons  with  Disabilities  Act; one member shall be an
18    appointee of the President of the Senate; one member shall be
19    an appointee of the  Minority  Leader  of  the  Senate;   one

29    an appointee of Western Illinois University; 2 members  shall
30    be appointees of the University of Illinois; one member shall
31    be  an  appointee of the Department of Commerce and Community
32    Affairs; and one member shall be an appointee of the Illinois
33    chapter  of  Economics  America.  Each  member   shall   have

 1    expertise  and  experience  in  the  area of entrepreneurship
 2    education, including  small  business  and  entrepreneurship.
 3    The  majority  of  voting  members  must  be from the private
 4    sector. The members initially appointed to the board  of  the
 5    Institute  created  under  this Section shall be appointed to
 6    take office on July 1, 1996 and shall by  lot  determine  the
 7    length  of their respective terms as follows: 6 members shall

31    Institute  so abolished and all of its property, whether real
32    or personal, including but not limited to all  inventory  and
33    equipment, shall be deemed transferred by operation of law to
34    the Illinois Institute for Entrepreneurship Education created

 1    under  this  Section  2-11.5.   The  Illinois  Institute  for
 2    Entrepreneurship  Education created under this Section 2-11.5
 3    shall have, with respect  to  the  predecessor  Institute  so
 4    abolished,  all  authority, powers, and duties of a successor
 5    agency under Section 10-15 of the Successor Agency Act.
 6        (g)  The  Institute  created  under   this   Section   is
 7    abolished  on  July  1, 1997, and the terms of the members of
 8    the board of the Institute so  abolished  are  terminated  on
 9    that  date.  All financial and other records of the Institute
10    so  abolished  and  all  of  the  property  of  that   former
11    Institute,  whether real or personal in nature, including but
12    not limited to all inventory and equipment, shall  be  deemed
13    transferred  on  July  1,  1997,  by operation of law, to the
14    Illinois Institute  for  Entrepreneurship  Education  created
15    under  Section 20-115 of the Illinois State University Law as
16    the successor of the Institute that is abolished as  provided
17    in this Section 2-11.5.
18        (h)  Subsections  (a)  through (f) of this Section 2-11.5
19    shall have no legal force or effect from and  after  July  1,
20    1997.
21        (i)  This Section is repealed on July 31, 1997.

23        Section  15.  The Higher Education Student Assistance Act
24    is amended by changing Section 37 as follows:
25        (110 ILCS 947/37)
26        Sec. 37. Higher education license plate grant program.
27        (a)  Each   year,   the   Illinois   Student   Assistance
28    Commission shall receive a  separate  appropriation  for  the
29    purpose of providing grant assistance to students enrolled at
30    Illinois  private  colleges and universities.  The Commission
31    shall, each year, receive and consider applications for grant
32    assistance  under  this  Section.   Subject  to  a   separate

 1    appropriation for such purposes, an applicant is eligible for
 2    a  grant to a degree-granting, not-for-profit private college
 3    or university located in this State under this  Section  when
 4    the Commission finds that the applicant:
 5             (1)  is  a  resident  of this State and a citizen or
 6        permanent resident of the United States; and
 7             (2)  in the absence of  grant  assistance,  will  be
 8        deterred  by  financial considerations from completing an
 9        educational program at the qualified institution  of  his
10        or her choice.
11        (b)  The  private  college or university Commission shall
12    award renewals only upon the student's application  and  upon
13    the institution's Commission's finding that the applicant:
14             (1)  has  remained  a  student in good standing at a
15        degree-granting,  not-for-profit   private   college   or
16        university located in this State;
17             (2)  remains a resident of this State; and
18             (3)  is  in  a financial situation that continues to
19        warrant assistance.
20        (c)  All grants shall be applicable only to  tuition  and
21    necessary  fee  costs  for  2  semesters  or 3 quarters in an
22    academic year.  Requests for summer term assistance  must  be
23    made  separately  and  shall  be  considered on an individual
24    basis  according  to  Commission  policy.   The   institution
25    Commission   shall   determine  the  grant  amount  for  each
26    full-time and part-time student, which shall be the  smallest
27    of the following amounts:
28             (1)  $2,000   for  2  semesters  or  3  quarters  of
29        full-time  undergraduate  enrollment  or  $1,000  for   2
30        semesters   or  3  quarters  of  part-time  undergraduate
31        enrollment, or such lesser amount as the Commission finds
32        to be available; or
33             (2)  the amount that equals the  tuition  and  other
34        necessary  fees  for  2  semesters or 3 quarters required

 1        generally   by   the   institution   of   all   full-time
 2        undergraduate students,  or  in  the  case  of  part-time
 3        students an amount of tuition and fees for 2 semesters or
 4        3  quarters  that  does not exceed one-half the amount of
 5        tuition and necessary fees generally charged to full-time
 6        undergraduate students by the institution; or
 7             (3)  such amount as the institution Commission finds
 8        to be appropriate in view of  the  applicant's  financial
 9        resources.
10    "Tuition  and  other  necessary fees" as used in this Section
11    includes the customary charge  for  instruction  and  use  of
12    facilities  in general, and the additional fixed fees charged
13    for specified  purposes,  which  are  required  generally  of
14    nongrant  recipients  for  each academic period for which the
15    grant applicant actually enrolls, but does not  include  fees
16    payable  only  once  or  breakage  fees  and other contingent
17    deposits that are  refundable  in  whole  or  in  part.   The
18    Commission  may prescribe, by rule not inconsistent with this
19    Section, detailed provisions concerning  the  computation  of
20    tuition and other necessary fees.
21        (d)  No  applicant,  including  those presently receiving
22    scholarship assistance under this Act, is eligible for  grant
23    program  consideration  under  this Section after receiving a
24    baccalaureate degree or the equivalent of 10 semesters or  15
25    quarters of award payments.  The institution Commission shall
26    determine  when  award  payments  for part-time enrollment or
27    interim or  summer  terms  shall  be  counted  as  a  partial
28    semester or quarter of payment.
29        (e)  The  Commission shall ensure that determine annually
30    the number  of  grants  to  be  offered  for  study  at  each
31    degree-granting, not-for-profit private college or university
32    in  this State, taking into consideration the amount of funds
33    available and past experience with the rate  of  grant  funds
34    unclaimed by recipients. in each school year the total amount

 1    of  grants  awarded  under  this  Section  for  study at each
 2    degree-granting, not-for-profit private college or university
 3    in this State shall be at least equal  to  the  total  amount
 4    deposited into the University Grant Fund from the issuance or
 5    renewal   of   license   plates  bearing  the  name  of  that
 6    degree-granting, not-for-profit private college or university
 7    during the calendar year preceding the calendar year in which
 8    the school year begins.
 9        The institution Commission shall notify  applicants  that
10    grant  assistance  is  contingent  upon  the  availability of
11    appropriated funds.

13        Section 20.  The Illinois  Vehicle  Code  is  amended  by
14    changing Section 3-629 (as added by P.A. 89-424) as follows:
15        (625 ILCS 5/3-629)
16        Sec. 3-629.  Collegiate license plates; scholarship fund.
17        (a)  In  addition to any other special license plate, the
18    Secretary,  upon  receipt  of   all   applicable   fees   and
19    applications  made in the form prescribed by the Secretary of
20    State, may issue collegiate license  plates.  The  collegiate
21    plates  issued  under  this  Section shall be affixed only to
22    passenger vehicles of the first division and  motor  vehicles
23    of  the  second  division weighing not more than 8,000 pounds
24    and subject to the  staggered  registration  system.   Plates
25    issued  under  this  Section  shall  expire  according to the
26    staggered  multi-year  procedure  established  under  Section
27    3-414.1 of this Code.
28        (b)  The design, color, and format of the plates shall be
29    wholly within the discretion of the Secretary of State.   The
30    Secretary  of  State may, at his or her discretion, issue the
31    plates for  any  public  or  degree-granting,  not-for-profit
32    private  college  or  university  located  in this State. The

 1    Secretary may, in his or her discretion, allow the plates  to
 2    be issued as vanity plates or personalized in accordance with
 3    Section 3-405.1 of this Code.  The plates are not required to
 4    designate  "Land Of Lincoln", as prescribed in subsection (b)
 5    of Section 3-412 of this Code.  The Secretary shall prescribe
 6    the eligibility requirements including  a  minimum  level  of
 7    specialized  license  plates  requests  and,  in  his  or her
 8    discretion, shall approve and prescribe stickers or decals as
 9    provided under Section 3-412.
10        (c)  An applicant shall be charged a $40 fee for original
11    issuance in addition to the applicable registration fee.   Of
12    the  original issuance fee in the case of a public university
13    or college, $25 shall be deposited into the State College and
14    University Trust Fund and $15 shall  be  deposited  into  the
15    Secretary  of  State Special License Plate Fund to be used by
16    the Secretary of State, subject  to  appropriation,  to  help
17    defray the administrative costs of issuing the plate.  Of the
18    original  issuance  fee  in  the  case  of a degree-granting,
19    not-for-profit private college or university,  $25  shall  be
20    deposited  into  the  University  Grant Fund and $15 shall be
21    deposited into the Secretary of State Special  License  Plate
22    Fund  to  be  used  by  the  Secretary  of  State, subject to
23    appropriation, to help  defray  the  administrative  cost  of
24    issuing  the  plate.  In addition to the regular renewal fee,
25    an applicant shall be charged $27 for the renewal of each set
26    of license plates issued under this  Section;  $25  shall  be
27    deposited into the State College and University Trust Fund in
28    the  case  of  a  public  university  or  college or into the
29    University Grant Fund  in  the  case  of  a  degree-granting,
30    not-for-profit private college or university, and $2 shall be
31    deposited  into  the Secretary of State Special License Plate
32    Fund plates for all collegiate plates.
33        (d)  The State  College  and  University  Trust  Fund  is
34    created  as a special fund in the State treasury.  All moneys

 1    in the State College  and  University  Trust  Fund  shall  be
 2    distributed  on  January  1  of  each  year  to  each  public
 3    university  or  college in proportion to the number of plates
 4    sold in regard to that university  or  college  according  to
 5    subsection  (c)  for  administration  of the Higher Education
 6    License Plate Grant program. Moneys deposited into the  State
 7    College and University Trust Fund shall be distributed to the
 8    public   university  or  college  for  the  sole  purpose  of
 9    scholarship grant awards.
10        (e)  The University Grant Fund is created  as  a  special
11    fund  in  the  State  treasury.  All moneys in the University
12    Grant Fund shall be  appropriated  to  the  Illinois  Student
13    Assistance Commission to make reimbursements to participating
14    private  colleges  and  universities  grants under the Higher
15    Education License Plate Grant Program.

17        Section 99.  Effective date.  This Act takes effect  upon
18    becoming law.
