LRB9003740DPcc HB1058 Engrossed LRB9003740DPcc 1 AN ACT concerning transportation, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Highway Code is amended by 5 changing Section 9-102 as follows: 6 (605 ILCS 5/9-102) (from Ch. 121, par. 9-102) 7 Sec. 9-102. The proper highway authorities are authorized 8 to keep vehicles of every kind off the public highways where 9 necessary to properly construct or repair the same. 10 Whenever any public highway including any bridge or 11 culvert thereon is being constructed or repaired, the highway 12 authorities having such work in charge shall, when they deem 13 it necessary, erect or cause to be erected at such points as 14 they deem desirable, suitable barriers, with signs thereon, 15 stating that such highway is closed, and by whose order. 16 Such authorities shall also erect or cause to be erected 17 at such places as they deem best, detour signs directing 18 travel around such construction or repair work. 19 Such signs and barricades shall conform to the Manual of 20 Uniform Traffic Control Devices adopted by the Department. 21 (Source: Laws 1961, p. 3509.) 22 Section 10. The Illinois Vehicle Code is amended by 23 adding Section 1-159.9 and changing Sections 1-191 and 3-812 24 as follows: 25 (625 ILCS 5/1-159.9 new) 26 Sec. 1-159.9. Permanently mounted equipment. Any 27 vehicle which has 2 separate power sources, one power source 28 primarily to supply motive force to the drive wheels and one 29 power source primarily to operate the mounted equipment. Any HB1058 Engrossed -2- LRB9003740DPcc 1 vehicle together with an apparatus or instrument permanently 2 affixed shall not be used to transport cargo or properties 3 which are not used in the direct operation of the permanently 4 mounted equipment. Permanently mounted equipment includes 5 vehicles to which a crane, other apparatus, or instrument has 6 been permanently attached; designed and used to perform 7 specific tasks: drilling, digging, lifting, mining, and other 8 such tasks. This definition shall not include equipment 9 which could function without being permanently mounted. 10 (625 ILCS 5/1-191) (from Ch. 95 1/2, par. 1-191) 11 Sec. 1-191. Special mobile equipment. Every vehicle not 12 designed or used primarily for the transportation of persons 13 or property and only incidentally operated or moved over a 14 highway, including but not limited to: street sweepers, ditch 15 digging apparatus, well boring apparatus and road 16 construction and maintenance machinery such as asphalt 17 spreaders, bituminous mixers, bucket loaders, tractors other 18 than truck tractors, ditchers, levelling graders, finishing 19 machines, motor graders, road rollers, scarifiers, earth 20 moving carryalls and scrapers, power shovels and drag lines, 21 and self-propelled cranes and earth moving equipment. The 22 term does not include house trailers, dump trucks, truck 23 mounted transit mixers, truck mounted cranes,ortruck 24 mounted shovels, or other vehicles designed for the 25 transportation of persons or property to which machinery has 26 been attached. 27 (Source: P.A. 85-951.) 28 (625 ILCS 5/3-812) (from Ch. 95 1/2, par. 3-812) 29 Sec. 3-812. Vehicles with Permanently Mounted Equipment 30 - Registration Fees.
