          Amends the Illinois Highway  Code  to  provide  that  the
      district  treasurer  shall  receive  an  annual salary deemed
      appropriate (instead of not less  than  $100  nor  more  than
      $1,000  per year) and to be fixed by the county board in road
      districts in counties not under township organization.

 1        AN ACT concerning transportation, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  3.  The  Metropolitan  Transit  Authority Act is
 5    amended by changing Section 28 as follows:
 6        (70 ILCS 3605/28) (from Ch. 111 2/3, par. 328)
 7        Sec. 28.  The  Board  shall  classify  all  the  offices,
 8    positions   and  grades  of  regular  and  exempt  employment
 9    required, excepting that of the Chairman of  the  Board,  the
10    Executive  Director,  Secretary,  Treasurer, General Counsel,
11    and Chief Engineer, with reference to the duties, job  title,
12    job schedule number, and the compensation fixed therefor, and
13    adopt  rules governing appointments to any of such offices or
14    positions on the basis of merit and efficiency. The job title
15    shall be generally descriptive of  the  duties  performed  in
16    that  job,  and  the  job  schedule  number  shall be used to
17    identify a job title and to further classify positions within
18    a  job  title.  No  discrimination  shall  be  made  in   any
19    appointment or promotion to any office, position, or grade of
20    regular  employment  because  of  race,  creed,  color,  sex,
21    national  origin,  physical  or  mental handicap unrelated to
22    ability, or political or religious affiliations.  No  officer
23    or  employee  in  regular  employment  shall be discharged or
24    demoted except for cause which is detrimental to the service.
25    Any  officer  or  employee  in  regular  employment  who   is
26    discharged  or  demoted  may file a complaint in writing with
27    the Board  within  ten  days  after  notice  of  his  or  her
28    discharge or demotion.  If an employee is a member of a labor
29    organization  the complaint may be filed by such organization
30    for and in behalf of such employee.  The Board shall grant  a
31    hearing on such complaint within thirty (30) days after it is

 1    filed.   The  time and place of the hearing shall be fixed by
 2    the Board and due notice thereof given  to  the  complainant,
 3    the  labor organization by or through which the complaint was
 4    filed and  the  Executive  Director.  The  hearing  shall  be
 5    conducted  by  the  Board,  or  any  member  thereof  or  any
 6    officers'  committee or employees' committee appointed by the
 7    Board.  The complainant may be represented  by  counsel.   If
 8    the  Board  finds,  or  approves  a  finding of the member or
 9    committee appointed by the Board, that  the  complainant  has
10    been  unjustly  discharged  or  demoted,  he  or she shall be
11    restored to his or her office or position with back pay.  The
12    decision of the Board shall  be  final  and  not  subject  to
13    review.  The Board may designate such offices, positions, and
14    grades of employment as exempt as it deems necessary for  the
15    efficient  operation  of  the business of the Authority.  The
16    total  number  of   employees   occupying   exempt   offices,
17    positions,  or  grades of employment may not exceed 3% of the
18    total employment  of  the  Authority.   All  exempt  offices,
19    positions,  and  grades  of  employment shall be at will.  No
20    discrimination shall be made in any appointment or  promotion
21    to  any  office,  position,  or  grade  of  exempt employment
22    because of race, creed, color, sex, national origin, physical
23    or mental handicap unrelated  to  ability,  or  religious  or
24    political  affiliation.  The  Board may abolish any vacant or
25    occupied office or position.   Additionally,  the  Board  may
26    reduce  the  force  of  employees for lack of work or lack of
27    funds  as  determined  by  the  Board.  When  the  number  of
28    positions  or  employees   holding   positions   of   regular
29    employment  within  a  particular  job title and job schedule
30    number are reduced, those employees with  the  least  company
31    seniority  in that job title and job schedule number shall be
32    first released from regular employment service.  For a period
33    of one year, an  employee  released  from  service  shall  be
34    eligible  for reinstatement to the job title and job schedule

 1    number from which he or she was released, in order of company
 2    seniority, if additional  force  of  employees  is  required.
 3    "Company seniority" as used in this Section means the overall
 4    employment  service  credited to an employee by the Authority
 5    since the employee's most recent date of hire irrespective of
 6    job titles held.  If  2  or  more  employees  have  the  same
 7    company  seniority  date,  time in the affected job title and
 8    job schedule number  shall  be  used  to  break  the  company
 9    seniority   tie.   For  purposes  of  this  Section,  company
10    seniority shall be  considered  a  working  condition.   When
11    employees  are represented by a labor organization that has a
12    labor agreement with the Authority,  the  wages,  hours,  and
13    working  conditions (including, but not limited to, seniority
14    rights) shall be governed by  the  terms  of  the  agreement.
15    Exempt  employment  shall  not  include any employees who are
16    represented  by  a  labor  organization  that  has  a   labor
17    agreement with the Authority.

19        Section  5.   The  Illinois  Highway  Code  is amended by
20    adding  Section  6-131  and  by  changing  Section  6-207  as
21    follows:
22        (605 ILCS 5/6-131 new)
23        Sec.  6-131.  Senior  citizen  transportation  and   mass
24    transit  programs;  district  road fund.  A road district may
25    use money in its district road fund to pay for all or part of
26    the direct costs of senior citizen transportation programs or
27    senior citizen mass transit programs, or both.

29        Sec. 6-207.  Compensation  of  highway  commissioner  and
30    other officers.
31        (a)  Unless an annual salary is fixed as provided in this

 1    Section,  the highway commissioner shall receive for each day
 2    he or  she  is  necessarily  employed  in  the  discharge  of
 3    official duties a per diem to be fixed by the county board in
 4    road  districts  in counties not under township organization,
 5    by the highway board of  trustees  in  consolidated  township
 6    road  districts,  and  by  the  board  of  town  trustees  in
 7    districts composed of a single township.  Before any per diem
 8    is paid, a sworn statement shall be filed by the commissioner
 9    in  the  office  of the district clerk, showing the number of
10    days the commissioner was employed, the kind  of  employment,
11    and the dates of employment.
12        The  boards  specified  in  the  preceding paragraph may,
13    instead of a per diem, fix an annual salary for  the  highway
14    commissioner  at  not  less  than $3,000, to be paid in equal
15    monthly installments.  The boards shall fix the  compensation
16    of  the commissioner, whether an annual salary or a per diem,
17    on or before the last Tuesday in March  before  the  date  of
18    election of the commissioner.
19        If  the  term  of any highway commissioner is extended by
20    operation of law, the board  that  fixes  the  commissioner's
21    rate   of   compensation   may   increase  the  rate  of  the
22    compensation, within the limits provided in this Section,  in
23    relation  to  that  portion  of  the commissioner's term that
24    extends beyond the period for which he or she was elected.
25        The board of town trustees shall  order  payment  of  the
26    amount  of  per  diem  claimed  in the highway commissioner's
27    sworn statement at the first regular  meeting  following  the
28    filing  of  the  statement.   In  consolidated  township road
29    districts, the compensation and the expenses of  the  offices
30    of  the  highway  commissioner,  district clerk, and district
31    treasurer shall be audited by the highway board of trustees.
32        The compensation of the  highway  commissioner  shall  be
33    paid from the general township fund in districts comprised of
34    a  single  township  and  shall be paid from the regular road

 1    fund in all other  districts  having  highway  commissioners;
 2    however,  in  districts  comprised  of  a  single township, a
 3    portion (not exceeding 50%)  of  the  highway  commissioner's
 4    salary may be paid from the corporate road and bridge fund or
 5    the permanent road fund if approved by the township board and
 6    the highway commissioner.
 7        (b)  The officers composing the highway board of trustees
 8    in  consolidated township road districts shall be entitled to
 9    $3 per day for attending meetings of the board,  to  be  paid
10    out  of  the  town  fund  of  their respective townships.  In
11    consolidated township road districts, the compensation of the
12    district clerk and the district treasurer shall be  paid  out
13    of the road fund of the district.
14        (c)  The district clerk shall receive $4 per day for each
15    day  he  or  she  shall  be required to meet with the highway
16    commissioner and the same amount per day for the time  he  or
17    she shall be employed in canvassing the returns of elections.
18    The  district  clerk  shall  receive  no  other per diem.  In
19    addition to the above, the district clerk shall also  receive
20    fees  for  the  following  services,  to  be  paid out of the
21    district road fund, except where otherwise specified:
22             (1)  For serving notice of election  or  appointment
23        upon district officers as required by this Code, 25 cents
24        each.
25             (2)  For  posting  up  notices  required  by law, 25
26        cents each.
27             (3)  For copying any record in the district  clerk's
28        office and certifying to the copy, 10 cents for every 100
29        words,  to  be  paid  by  the  person  applying  for  the
30        certified copy.
31        (d)  Except  as  otherwise  provided  in  this  Code, the
32    district  treasurer  shall,  in   addition   to   any   other
33    compensation  to  which he or she is by law entitled, receive
34    an annual salary of not less than $100 nor more  than  $1,000

 1    per year to be fixed by the county board in road districts in
 2    counties  not  under  township  organization,  by the highway
 3    board of trustees in consolidated  township  road  districts,
 4    and  by the board of town trustees in districts composed of a
 5    single township.
 6        Except as otherwise provided in this Code,  the  district
 7    treasurer  shall,  in  addition  to any other compensation to
 8    which he or she is by law entitled, receive an annual  salary
 9    deemed  appropriate  and  to  be fixed by the county board in
10    road districts in counties not under township organization.
11        The compensation of the district treasurer shall be  paid
12    from  the  general  township  fund in districts composed of a
13    single township and shall be paid from the regular road  fund
14    in all other districts having district treasurers.
