90_SB0320ccr001 LRB9001689SMdvccr1 1 90TH GENERAL ASSEMBLY 2 CONFERENCE COMMITTEE REPORT 3 ON SENATE BILL 320 4 ------------------------------------------------------------- 5 ------------------------------------------------------------- 6 To the President of the Senate and the Speaker of the 7 House of Representatives: 8 We, the conference committee appointed to consider the 9 differences between the houses in relation to House 10 Amendments Nos. 2, 3, 4, 5, and 6 to Senate Bill 320, 11 recommend the following: 12 (1) that the House recede from House Amendments Nos. 2, 13 3, 4, 5, and 6; and 14 (2) that Senate Bill 320 be amended by replacing the 15 title with the following: 16 "AN ACT to amend the Illinois Public Aid Code by adding 17 Section 12-4.34 and repealing Section 12-4.32."; and 18 by replacing everything after the enacting clause with the 19 following: 20 "Section 5. The Illinois Public Aid Code is amended by 21 adding Section 12-4.34 as follows: 22 (305 ILCS 5/12-4.34 new) 23 Sec. 12-4.34. Naturalization and nutrition services to 24 noncitizens. 25 (a) Subject to specific appropriation for this purpose, 26 the Department of Human Services is authorized to provide 27 naturalization services to legal immigrants. 28 (b) Subject to specific appropriation for this purpose, 29 the Department of Human Services is authorized to provide 30 nutrition services to noncitizens who are 65 years of age or 31 older, under 18 years of age, or disabled, and who were in 32 the United States prior to August 22, 1996 and are not -2- LRB9001689SMdvccr1 1 eligible for the federal food stamp program due to their 2 noncitizen status. The payment levels and other eligibility 3 conditions for these services shall be determined by rule. 4 The Illinois Department is authorized to lower the 5 payment levels established under this subsection or take such 6 other actions during the fiscal year as are necessary to 7 ensure that payments under this subsection do not exceed the 8 amounts appropriated for this purpose. These changes may be 9 accomplished by emergency rule under Section 5-45 of the 10 Illinois Administrative Procedure Act, except that the 11 limitation on the number of emergency rules that may be 12 adopted in a 24-month period shall not apply. 13 (c) This Section is repealed on August 31, 1998. 14 (305 ILCS 5/12-4.32 rep.) 15 Section 10. The Illinois Public Aid Code is amended by 16 repealing Section 12-4.32. 17 Section 99. Effective date.
