person under the age of 13 to wear a personal floatation

1 AN ACT to amend the Boat Registration and Safety Act by
2 changing Section 4-1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Boat Registration and Safety Act is
6 amended by changing Section 4-1 as follows:
7 (625 ILCS 45/4-1) (from Ch. 95 1/2, par. 314-1)
8 Sec. 4-1. Personal flotation devices.
9 A. No person may operate a watercraft unless at least
10 one U.S. Coast Guard approved PFD of the following types or
11 their equivalent is on board for each person: Type I, Type
12 II or Type III.
13 B. No person may operate a personal watercraft or
14 specialty prop-craft unless each person aboard is wearing a
15 Type I, Type II, Type III or Type V PFD approved by the
16 United States Coast Guard.
17 C. No person may operate a watercraft 16 feet or more in
18 length, except a canoe or kayak, unless at least one Type IV
19 U.S. Coast Guard approved PFD or its equivalent is on board
20 in addition to the PFD's required in paragraph A of this
21 Section.
22 D. A U.S. Coast Guard approved Type V personal flotation
23 device may be carried in lieu of the Type I, II, III or IV
24 personal flotation device required in this Section, if the
25 Type V personal flotation device is approved for the activity
26 in which it is being used.
27 E. When assisting a person on waterskis, aquaplane or
28 similar device, there must be one U.S. Coast Guard approved
29 PFD on board the watercraft for each person being assisted or
30 towed or worn by the person being assisted or towed.
31 F. No person may operate a watercraft unless each device

1 required by this Section is:
2 1. Readily accessible;
3 2. In serviceable condition;
4 3. Of the appropriate size for the person for whom
5 it is intended; and
6 4. Legibly marked with the U.S. Coast Guard
7 approval number.
8 G. Approved personal flotation devices are defined as
9 follows:
10 Type I - A Type I personal flotation device is an
11 approved device designed to turn an unconscious person in
12 the water from a face downward position to a vertical or
13 slightly backward position and to have more than 20
14 pounds of buoyancy.
15 Type II - A Type II personal flotation device is an
16 approved device designed to turn an unconscious person in
17 the water from a face downward position to a vertical or
18 slightly backward position and to have at least 15 1/2
19 pounds of buoyancy.
20 Type III - A Type III personal flotation device is
21 an approved device designed to keep a conscious person in
22 a vertical or slightly backward position and to have at
23 least 15 1/2 pounds of buoyancy.
24 Type IV - A Type IV personal flotation device is an
25 approved device designed to be thrown to a person in the
26 water and not worn. It is designed to have at least 16
27 1/2 pounds of buoyancy.
28 Type V - A Type V personal flotation device is an
29 approved device for restricted use and is acceptable only
30 when used in the activity for which it is approved.
31 H. The provisions of subsections A through G of this
32 Section shall not apply to sailboats.
33 I. No person may operate a watercraft under 26 feet in
34 length unless a Type I, Type II, Type III, or Type V personal

1 flotation device is being properly worn by each person under
2 the age of 13 on board the watercraft at all times in which
3 the watercraft is underway; however, this requirement shall
4 not apply to persons who are below decks or in totally
5 enclosed cabin spaces. The provisions of this subsection I
6 shall not apply to a person operating a watercraft on private
7 property.
