305 ILCS 5/11-14.5
Amends provisions of the Illinois Public Aid Code
regarding recovery by recoupment or any other legal means
consistent with State and federal law of public aid given to
applicants or recipients who are not entitled to the aid,
regardless of the cause of the overpayment. Authorizes local
governmental units to recoup or recover assistance by any
other legal means consistent with State and federal law given
to applicants or recipients not entitled, regardless of the
cause of the overpayment. Effective immediately.

1 AN ACT to amend the Illinois Public Aid Code by changing
2 Section 11-14.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 changing Section 11-14.5 as follows:
7 (305 ILCS 5/11-14.5)
8 Sec. 11-14.5. Overpayment; recovery. If an applicant or
9 recipient receives any form of public aid from the Illinois
10 Department or a local governmental unit to which he or she is
11 not entitled, the Illinois Department or local governmental
12 unit may determine that the applicant or recipient has
13 received an overpayment of public aid. The Illinois
14 Department may determine that an overpayment has been
15 received regardless of any determination of the cause of the
16 overpayment, including but not limited to a determination
17 that the overpayment was caused by an error of the Illinois
18 Department or local governmental unit. The Illinois
19 Department or local governmental unit may attempt to recover
20 the overpayment by recoupment from future assistance payments
21 or food stamps or any other legal means consistent with State
22 and federal law.

24 Section 99. Effective date. This Act takes effect upon
25 becoming law.
