Amend Senate Bill 698 on page 1, by 3 replacing lines 1 and 2 with the following: 4 "AN ACT to amend the Illinois Public Aid Code by adding 5 Section 4-20 and changing Section 11-14.5."; and 6 on page 1, by replacing lines 5 and 6 with the following: 7 "Section 5. The Illinois Public Aid Code is amended by 8 adding Section 4-20 and changing Section 11-14.5 as follows: 9 (305 ILCS 5/4-20 new) 10 Sec. 4-20. Child support income budgeting. 11 (a) Legislative findings. The General Assembly finds 12 that families receiving aid under this Article should be 13 encouraged to secure income from child support to better 14 position themselves for transition off welfare. The General 15 Assembly further finds that the current methods of budgeting 16 child support income for families receiving aid under this 17 Article is complicated and penalizes families with earnings 18 from employment who have child support collected on their 19 behalf. 20 (b) For families receiving cash assistance under this 21 Article who have both earned income and child support income, -2- LRB9001277WHmgam01 1 the Department shall distribute to the family all child 2 support, up to the amount of the monthly current support 3 obligation or obligations received on behalf of all children 4 in the household who receive cash assistance. The Department 5 shall budget the child support income by reducing the monthly 6 cash assistance for the household by an amount equal to 7 one-third of the child support distributed to the household 8 under this Section. The household shall continue to be 9 eligible for cash assistance under this Article if the total 10 monthly income for the household from the combination of 11 budgeted earned income and budgeted child support does not 12 exceed the federal poverty level as defined by the United 13 States Department of Health and Human Services. 14 Implementation of this budgeting process is contingent on the 15 Department's either receiving confirmation from the United 16 States Department of Health and Human Services that the 17 federal government will not claim any of the child support 18 distributed to families under this budgeting process as the 19 federal share of the amount collected or obtaining a waiver 20 from the United States Department of Health and Human 21 Services allowing use of this budgeting process and releasing 22 the federal government's claim to the federal share of the 23 amount collected. 24 (c) Families receiving assistance under this Article who 25 are entitled under federal or State law or court order to 26 have the unearned income of a household member who is not 27 included in the assistance unit earmarked or excluded from 28 consideration in the budgeting process shall have the right 29 to choose whether to have that unearned income earmarked or 30 excluded or to have it budgeted according to subsection 31 (b)."; and 32 on page 1, by replacing lines 24 and 25 with the following: 33 "Section 99. Effective date. This Act takes effect upon -3- LRB9001277WHmgam01 1 becoming law, except that the provisions adding Section 4-20 2 to the Illinois Public Aid Code take effect on July 1, 3 1997.".
