Amend Senate Bill 698, AS AMENDED, 3 by replacing the title with the following: 4 "AN ACT to amend the Illinois Public Aid Code by changing 5 Sections 4-1.6 and 11-14.5."; and 6 in Section 5, by replacing the introductory clause and all of 7 Sec. 4-20 with the following: 8 "Section 5. The Illinois Public Aid Code is amended by 9 changing Sections 4-1.6 and 11-14.5 as follows: 10 (305 ILCS 5/4-1.6) (from Ch. 23, par. 4-1.6) 11 Sec. 4-1.6. Need). Income available to the family, or to 12 the child in the case of a child removed from his or her 13 home, when added to contributions in money, substance or 14 services from other sources, including income available from 15 parents absent from the home or from a stepparent, 16 contributions made for the benefit of the parent or other 17 persons necessary to provide care and supervision to the 18 child, and contributions from legally responsible relatives, 19 must be insufficient to equal the grant amount established by 20 Department regulation for such a person. 21 In considering income to be taken into account, -2- LRB9001277SMpkam 1 consideration shall be given to any expenses reasonably 2 attributable to the earning of such income. The Illinois 3 Department may also, subject to such limitations as may be 4 prescribed by federal law or regulation, permit all or any 5 portion of earned or other income to be set aside for the 6 future identifiable needs of a child. If federal law or 7 regulations permit or require exemption of other income of 8 recipients, the Illinois Department may provide by rule and 9 regulation for the exemptions thus permitted or required. 10 The eligibility of any applicant for or recipient of public 11 aid under this Article is not affected by the payment of any 12 grant under the "Senior Citizens and Disabled Persons 13 Property Tax Relief and Pharmaceutical Assistance Act". 14 For families on cash assistance under this Article who 15 have earned income budgeted, any child support actually 16 distributed to the family over the first $50 shall be 17 budgeted in the same manner as earned income is budgeted 18 under this Article. 19 (Source: P.A. 84-832.)"; and 20 by replacing Section 99 with the following: 21 "Section 99. Effective date. This Act takes effect upon 22 becoming law, except that the provisions changing Section 23 4-1.6 of the Illinois Public Aid Code take effect on July 1, 24 1997.".
