90_SB1674ccr001 LRB9011420DJcdccr1 1 90TH GENERAL ASSEMBLY 2 CONFERENCE COMMITTEE REPORT 3 ON SENATE BILL 1674 4 ------------------------------------------------------------- 5 ------------------------------------------------------------- 6 To the President of the Senate and the Speaker of the 7 House of Representatives: 8 We, the conference committee appointed to consider the 9 differences between the houses in relation to House 10 Amendments Nos. 1, 2, and 3 to Senate Bill 1674, recommend 11 the following: 12 (1) That the House recede from House Amendment No. 1; and 13 (2) That the Senate concur in House Amendments Nos. 2 and 14 3; and 15 (3) That Senate Bill 1674, AS AMENDED, be further amended 16 as follows: 17 after the last line of Section 30, by inserting the 18 following: 19 "Section 90. The Legislative Information System Act is 20 amended by adding Section 5.09 and changing Sections 5 and 6 21 as follows: 22 (25 ILCS 145/5) (from Ch. 63, par. 42.15) 23 Sec. 5. The System has the duties enumerated in the 24 following Sections preceding Section 65.01 through 5.07. 25 (Source: P.A. 80-683.) 26 (25 ILCS 145/5.09 new) 27 Sec. 5.09. Public computer access; legislative 28 information. To make available to the public all of the 29 following information in electronic form: 30 (1) On or before July 1, 1999, the weekly schedule 31 of legislative floor sessions for each of the 2 houses of -2- LRB9011420DJcdccr1 1 the General Assembly together with a list of matters 2 pending before them and the weekly schedule of 3 legislative committee hearings together with matters 4 scheduled for their consideration. 5 (2) On or before July 1, 1999, a list of the 6 committees of the General Assembly and their members. 7 (3) On or before July 1, 1999, the text of each 8 bill and resolution introduced and of each engrossed, 9 enrolled, and re-enrolled bill and resolution and the 10 text of each adopted amendment and conference committee 11 report. 12 (4) On or before July 1, 1999, a synopsis of items 13 specified in paragraph (3) of this Section, together with 14 a summary of legislative and gubernatorial actions 15 regarding each bill and resolution introduced. 16 (5) On or before July 1, 1999, the Rules of the 17 House and the Senate of the General Assembly. 18 (6) Before the conclusion of the Ninety-second 19 General Assembly, the text of Public Acts. 20 (7) Before the conclusion of the Ninety-second 21 General Assembly, the Illinois Compiled Statutes. 22 (8) Before the conclusion of the Ninety-second 23 General Assembly, the Constitution of the United States 24 and the Constitution of the State of Illinois. 25 (9) Before the conclusion of the Ninety-second 26 General Assembly, the text of the Illinois Administrative 27 Code. 28 (10) Before the conclusion of the Ninety-second 29 General Assembly, the most current issue of the Illinois 30 Register published on or after the effective date of this 31 amendatory Act of 1998. 32 (11) Any other information that the Joint Committee 33 on Legislative Support Services elects to make available. 34 The information shall be made available to the public 35 through the World Wide Web. The information may also be -3- LRB9011420DJcdccr1 1 made available by any other means of access that would 2 facilitate public access to the information. 3 Any documentation that describes the electronic digital 4 formats of the information shall be made available through 5 the World Wide Web. 6 Personal information concerning a person who accesses 7 this public information may be maintained only for the 8 purpose of providing service to the person. 9 No fee or other charge may be imposed by the Legislative 10 Information System as a condition of accessing the 11 information, except that a reasonable fee may be charged for 12 any customized services and shall be deposited into the 13 General Assembly Computer Equipment Revolving Fund. 14 The electronic public access provided through the World 15 Wide Web shall be in addition to any other electronic or 16 print distribution of the information. 17 No action taken under this Section shall be deemed to 18 alter or relinquish any copyright or other proprietary 19 interest or entitlement of the State of Illinois relating to 20 any of the information made available under this Section. 21 The information shall be made available as provided in 22 this Section in the shortest practicable time after it is 23 publicly available in any other form; provided that the 24 System may make information available under this Section only 25 if the availability in no way reduces the quality and 26 timeliness of service available to and required under this 27 Act for legislative users and does not unduly burden the 28 General Assembly or its support services agencies. Failure 29 to provide information under this Section does not affect the 30 validity of any action of the General Assembly. The General 31 Assembly and the State of Illinois are not liable for the 32 accuracy, availability, or use of the information provided 33 under this Section. 34 (25 ILCS 145/6) (from Ch. 63, par. 42.16) -4- LRB9011420DJcdccr1 1 Sec. 6. Computer systems; private use; charges. In 2 addition to the information made available by the Legislative 3 Information System under Section 5.09, the System may make 4 the computer systems under its jurisdiction available for use 5 by private persons or governmental entities or agencies, 6 other than those legislative users specified in Section 5.06, 7 if: 8 (a) such availability in no way reduces the quality of 9 service available to and required under this Act for 10 legislative users; 11 (b) the System, by resolution adopts rules and 12 conditions regarding the offering of such services and 13 specifies the charges to be made therefor. These charges may 14 be based on usage of the services; and 15 (c) the System collects the appropriate charges for the 16 services rendered. Those amounts shall be deposited in the 17 General Assembly Computer Equipment Revolving Fund, a special 18 fund which is hereby created in the State treasury.
