 1                    AMENDMENT TO SENATE BILL 1674
 2        AMENDMENT NO.     .  Amend Senate Bill 1674 on page 1, by
 3    replacing line 1 with the following:
 4        "AN ACT in relation to computers."; and
 5    on page 4, by replacing lines 9 and 10 with the following:
 6        "Section 90.  The Legislative Information System  Act  is
 7    amended  by adding Section 5.09 and changing Sections 5 and 6
 8    as follows:
 9        (25 ILCS 145/5) (from Ch. 63, par. 42.15)
10        Sec. 5.  The System has  the  duties  enumerated  in  the
11    following Sections preceding Section 6 5.01 through 5.07.

13        (25 ILCS 145/5.09 new)
14        Sec.    5.09.  Public   computer   network;   legislative
15    information.  To make available to  the  public  all  of  the
16    following information in electronic form:
17             (1)  Beginning   with   the   Ninety-First   General
18        Assembly,  the  weekly legislative calendar, the schedule
19        of weekly  legislative  committee  hearings,  a  list  of
20        matters  pending  before the General Assembly, and a list

 1        of the committees  of  the  General  Assembly  and  their
 2        members.
 3             (2)  Beginning   with   the   Ninety-first   General
 4        Assembly, the text of each bill and resolution introduced
 5        and  each  engrossed,  enrolled, and re-enrolled bill and
 6        resolution, and the text of each  adopted  amendment  and
 7        conference committee report.
 8             (3)  Beginning   with   the   Ninety-first   General
 9        Assembly,  a  summary  of  legislative  and gubernatorial
10        action regarding each bill introduced.
11             (4)  Beginning   with   the   Ninety-first   General
12        Assembly, the Journals of the House and Senate.
13             (5)  The Illinois Compiled Statutes.
14             (6)  The United States Constitution and the Illinois
15        Constitution.
16             (7)  Beginning   with   the   Ninety-first   General
17        Assembly, Public Acts.
18             (8)  Beginning   with   the   Ninety-first   General
19        Assembly, House and Senate Rules.
20             (9)  Issues of the Illinois Register published on or
21        after the effective date of this amendatory Act of 1998.
22             (10)  The Illinois Administrative Code.
23             (11)  Any other information the Joint  Committee  on
24        Legislative Support Services elects to make available.
25        The  information  shall  be  made available to the public
26    through the World Wide Web.   The  information  may  also  be
27    made  available  by  any  other  means  of  access that would
28    facilitate public access to the information.
29        Any documentation that describes the  electronic  digital
30    formats  of  the  information shall be made available through
31    the World Wide Web.
32        Personal information concerning a person who accesses the
33    information  may  be  maintained  only  for  the  purpose  of
34    providing service to the person.

 1        No fee or other charge may be imposed by the  Legislative
 2    Information   System   as   a   condition  of  accessing  the
 3    information, except that a reasonable fee may be charged  for
 4    any  customized  services  and  shall  be  deposited into the
 5    General Assembly Computer Equipment Revolving Fund.
 6        The electronic public access provided through  the  World
 7    Wide  Web  shall  be in addition to other electronic or print
 8    distribution of the information.
 9        No action taken under this Section  shall  be  deemed  to
10    alter  or  relinquish  any  copyright  or  other  proprietary
11    interest  or entitlement of the State of Illinois relating to
12    any of the information made available under this Section.
13        The information shall be made available in  the  shortest
14    feasible time after it is publicly available; except that the
15    System may make information available under this Section only
16    if  the  availability  in  no  way  reduces  the  quality and
17    timeliness of service available to and  required  under  this
18    Act  for  legislative  users  and  does not unduly burden the
19    General Assembly or its support services  agencies.   Failure
20    to  provide  the  information does not affect the validity of
21    any action of the General Assembly.  The General Assembly and
22    the State of  Illinois  are  not  liable  for  the  accuracy,
23    availability, or use of the information.

25        Sec.  6.   Computer  systems;  private  use; charges.  In
26    addition to the information made available by the Legislative
27    Information System under Section 5.09, the  System  may  make
28    the computer systems under its jurisdiction available for use
29    by  private  persons  or  governmental  entities or agencies,
30    other than those legislative users specified in Section 5.06,
31    if:
32        (a)  such availability in no way reduces the  quality  of
33    service   available  to  and  required  under  this  Act  for

 1    legislative users;
 2        (b)  the  System,  by   resolution   adopts   rules   and
 3    conditions  regarding  the  offering  of  such  services  and
 4    specifies the charges to be made therefor.  These charges may
 5    be based on usage of the services; and
 6        (c)  the  System collects the appropriate charges for the
 7    services rendered. Those amounts shall be  deposited  in  the
 8    General Assembly Computer Equipment Revolving Fund, a special
 9    fund  which  is hereby created in the State treasury.  Monies
10    in the Fund shall be appropriated to the Joint  Committee  on
11    Legislative  Support  Services  for  the purchase of computer
12    equipment for the General Assembly and for  related  expenses
13    and for other operational purposes of the General Assembly.

15        Section  99.  Effective date.  This Act takes effect upon
16    becoming law, except that Section 90 takes effect on  January
17    1, 1999.".
