91_HB0540eng HB0540 Engrossed LRB9101231WHdv 1 AN ACT to amend certain Acts in relation to child 2 support. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 adding Section 12-12.1 as follows: 7 (305 ILCS 5/12-12.1 new) 8 Sec. 12-12.1. World Wide Web page. The Illinois 9 Department of Public Aid shall create and maintain or cause 10 to be created and maintained one or more World Wide Web pages 11 containing information on selected individuals who are in 12 arrears in their child support obligations under an Illinois 13 court order or administrative order. The information 14 regarding each of the individuals shall include the 15 individual's name, a photograph if available, the amount of 16 the child support arrearage, and any other information deemed 17 appropriate by the Illinois Department in its discretion. The 18 individuals may be chosen by the Illinois Department using 19 criteria including, but not limited to, the amount of the 20 arrearage, the effect of inclusion of an individual upon the 21 likelihood of the individual's payment of an arrearage, the 22 motivational effect that inclusion of an individual may have 23 on the willingness of other individuals to pay their 24 arrearages, or the need to locate a particular individual. 25 The Illinois Department shall make the page or pages 26 accessible to Internet users through the World Wide Web. The 27 Illinois Department, in its discretion, may change the 28 contents of the page or pages from time to time. 29 Before including information on the World Wide Web page 30 concerning an individual who owes past due support, the 31 Illinois Department shall, pursuant to rule, provide the HB0540 Engrossed -2- LRB9101231WHdv 1 individual with notice and an opportunity to be heard. Any 2 final administrative decision rendered by the Illinois 3 Department shall be reviewed only under and in accordance 4 with the Administrative Review Law. 5 Section 10. The Clerks of Courts Act is amended by 6 adding Section 15.1 as follows: 7 (705 ILCS 105/15.1 new) 8 Sec. 15.1. Child support information. The clerks of the 9 circuit courts may, upon request, cooperate with and supply 10 information to counties and municipalities wishing to create 11 and maintain World Wide Web pages containing information on 12 individuals who are in arrears in their child support 13 obligations and have been found to be in contempt of court as 14 a result of the existence of that arrearage. 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.
