92_HB4937eng HB4937 Engrossed LRB9209512DHcd 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 3. The State Finance Act is amended by adding 5 Section 5.570 as follows: 6 (30 ILCS 105/5.570 new) 7 Sec. 5.570. The Professional Sports Teams Education 8 Fund. 9 Section 5. The Illinois Vehicle Code is amended by 10 changing Sections 3-621, 3-622, 3-623, 3-625, and 3-806.3 and 11 renumbering Sections 3-648 as added by Public Act 92-79 and 12 3-648 as added by Public Act 92-467 and by adding Section 13 3-654 as follows: 14 (625 ILCS 5/3-621) (from Ch. 95 1/2, par. 3-621) 15 Sec. 3-621. The Secretary, upon receipt of an 16 application, made in the form prescribed by the Secretary of 17 State, may issue to members of the Illinois National Guard, 18 and to Illinois residents who are either former members of 19 the Illinois National Guard or the surviving spouses of 20 Illinois National Guard members, special registration plates. 21 The special plates issued pursuant to this Section shall be 22 affixed only to passenger vehicles of the first division or 23 motor vehicles of the second division weighing not more than 24 8,000 pounds subject to the staggered registration system. 25 The design and color of such plates shall be wholly 26 within the discretion of the Secretary of State. 27 (Source: P.A. 84-986.) 28 (625 ILCS 5/3-622) (from Ch. 95 1/2, par. 3-622) HB4937 Engrossed -2- LRB9209512DHcd 1 Sec. 3-622. The Secretary, upon receipt of an 2 application made in the form prescribed by the Secretary of 3 State, may issue to members of the United States Armed Forces 4 Reserves who reside in Illinois, and to Illinois residents 5 who are either former members of the United States Armed 6 Forces Reserves or the surviving spouses of United States 7 Armed Forces Reserve members who resided in Illinois, special 8 registration plates. The special plates issued pursuant to 9 this Section shall be affixed only to passenger vehicles of 10 the first division or motor vehicles of the second division 11 weighing not more than 8,000 pounds subject to the staggered 12 registration system. The design and color of such plates 13 shall be wholly within the discretion of the Secretary of 14 State. 15 (Source: P.A. 84-986.) 16 (625 ILCS 5/3-623) (from Ch. 95 1/2, par. 3-623) 17 Sec. 3-623. Purple Heart Plates. The Secretary, upon 18 receipt of an application made in the form prescribed by the 19 Secretary of State, may issue to recipients awarded the 20 Purple Heart by a branch of the armed forces of the United 21 States who reside in Illinois, special registration plates. 22 The special plates issued pursuant to this Section should be 23 affixed only to passenger vehicles of the 1st division, 24 including motorcycles, or motor vehicles of the 2nd division 25 weighing not more than 8,000 pounds. 26 The design and color of such plates shall be wholly 27 within the discretion of the Secretary of State. Appropriate 28 documentation, as determined by the Secretary, and the 29 appropriatestandardregistration fee shall accompany the 30 application. However, for an individual who has been issued 31 Purple Heart plates for a vehicle and who has claimed and 32 received a grant under the Senior Citizens and Disabled 33 Persons Property Tax Relief and Pharmaceutical Assistance HB4937 Engrossed -3- LRB9209512DHcd 1 Act, theoriginal issuance fee and regularannual fee for the 2 registration of the vehicle shall be as provided in Section 3 3-806.3 of this Code. 4 (Source: P.A. 91-25, eff. 6-9-99; 92-82, eff. 1-1-02.) 5 (625 ILCS 5/3-625) (from Ch. 95 1/2, par. 3-625) 6 Sec. 3-625. Pearl Harbor Plates. The Secretary, upon 7 receipt of an application made in the form prescribed by the 8 Secretary of State, may issue special registration plates to 9 any Illinois resident who, while a member of the armed forces 10 of the United States, participated in the battle of Pearl 11 Harbor on December 7, 1941, or to the widowed spouse of any 12 Illinois resident who, while a member of the armed forces of 13 the United States, participated in the battle of Pearl Harbor 14 on December 7, 1941, provided that the widowed spouse was 15 married to the battle of Pearl Harbor participant at the time 16 of the participant's death and is a single person at the time 17 of application. The special plates issued pursuant to this 18 Section should be affixed only to passenger vehicles of the 19 1st division or motor vehicles of the 2nd division weighing 20 not more than 8,000 pounds. 21 The design and color of such plates shall be wholly 22 within the discretion of the Secretary of State. Appropriate 23 documentation, as determined by the Secretary, and the 24 appropriatestandardregistration fee shall accompany the 25 application. 26 (Source: P.A. 89-571, eff. 7-26-96; 89-620, eff. 1-1-97.) 27 (625 ILCS 5/3-650) 28 Sec. 3-650.3-648.Army Combat Veteran license plates. 29 (a) In addition to any other special license plate, the 30 Secretary, upon receipt of all applicable fees and 31 applications made in the form prescribed by the Secretary of 32 State, may issue Army Combat Veteran license plates to HB4937 Engrossed -4- LRB9209512DHcd 1 residents of Illinois who meet eligibility requirements 2 prescribed by the Secretary of State. The special Army 3 Combat Veteran plate issued under this Section shall be 4 affixed only to passenger vehicles of the first division and 5 motor vehicles of the second division weighing not more than 6 8,000 pounds. Plates issued under this Section shall expire 7 according to the staggered multi-year procedure established 8 by Section 3-414.1 of this Code. 9 (b) The plates shall display the Army Combat Infantry 10 Badge. In all other respects, the design, color, and format 11 of the plates shall be within the discretion of the Secretary 12 of State. The Secretary may, in his or her discretion, allow 13 the plates to be issued as vanity plates or personalized in 14 accordance with Section 3-405.1 of this Code. The plates are 15 not required to designate "Land Of Lincoln", as prescribed in 16 subsection (b) of Section 3-412 of this Code. The Secretary 17 shall prescribe the eligibility requirements and, in his or 18 her discretion, shall approve and prescribe stickers or 19 decals as provided under Section 3-412. 20 (c) An applicant shall be charged a $15 fee for original 21 issuance in addition to the applicable registration fee. 22 This additional fee shall be deposited into the Secretary of 23 State Special License Plate Fund. For each registration 24 renewal period, a $2 fee, in addition to the appropriate 25 registration fee, shall be charged and shall be deposited 26 into the Secretary of State Special License Plate Fund. 27 (Source: P.A. 92-79, eff. 1-1-02; revised 10-17-01.) 28 (625 ILCS 5/3-651) 29 Sec. 3-651.3-648.U.S. Marine Corps license plates. 30 (a) In addition to any other special license plate, the 31 Secretary, upon receipt of all applicable fees and 32 applications made in the form prescribed by the Secretary of 33 State, may issue special registration plates designated as HB4937 Engrossed -5- LRB9209512DHcd 1 U.S. Marine Corps license plates to residents of Illinois who 2 meet eligibility requirements prescribed by the Secretary of 3 State. The special plate issued under this Section shall be 4 affixed only to passenger vehicles of the first division, 5 motor vehicles of the second division weighing not more than 6 8,000 pounds, and recreational vehicles as defined by Section 7 1-169 of this Code. Plates issued under this Section shall 8 expire according to the staggered multi-year procedure 9 established by Section 3-414.1 of this Code. 10 (b) The design, color, and format of the plates shall be 11 wholly within the discretion of the Secretary of State, 12 except that the U.S. Marine Corps emblem shall appear on the 13 plates. The Secretary may, in his or her discretion, allow 14 the plates to be issued as vanity or personalized plates in 15 accordance with Section 3-405.1 of this Code. The plates are 16 not required to designate "Land Of Lincoln", as prescribed in 17 subsection (b) of Section 3-412 of this Code. The Secretary 18 shall prescribe the eligibility requirements and, in his or 19 her discretion, shall approve and prescribe stickers or 20 decals as provided under Section 3-412. 21 (c) An applicant shall be charged a $20 fee for original 22 issuance in addition to the applicable registration fee. Of 23 this additional fee, $15 shall be deposited into the 24 Secretary of State Special License Plate Fund and $5 shall be 25 deposited into the Marine Corps Scholarship Fund. For each 26 registration renewal period, a $20 fee, in addition to the 27 appropriate registration fee, shall be charged. Of this 28 additional fee, $2 shall be deposited into the Secretary of 29 State Special License Plate Fund and $18 shall be deposited 30 into the Marine Corps Scholarship Fund. 31 (d) The Marine Corps Scholarship Fund is created as a 32 special fund in the State treasury. All moneys in the Marine 33 Corps Scholarship Fund shall, subject to appropriation by the 34 General Assembly and approval by the Secretary, be used by HB4937 Engrossed -6- LRB9209512DHcd 1 the Marine Corps Scholarship Foundation, Inc., a recognized 2 charitable organization that meets the requirements of Title 3 26, Section 501(c)(3) of the United States Code, to provide 4 grants for scholarships for higher education. The scholarship 5 recipients must be the children of current or former members 6 of the United States Marine Corps who meet the academic, 7 financial, and other requirements established by the Marine 8 Corps Scholarship Foundation. In addition, the recipients 9 must be Illinois residents and must attend a college or 10 university located within the State of Illinois. 11 The State Treasurer shall require the Marine Corps 12 Scholarship Foundation to establish a separate account for 13 receipt of the proceeds of the Marine Corps Scholarship Fund. 14 That account shall be subject to audit either annually or at 15 another interval, as determined by the State Treasurer. 16 Proceeds from the Marine Corps Scholarship Fund shall be 17 transferred on a quarterly basis by the State Treasurer's 18 office to this separate account. 19 (Source: P.A. 92-467, eff. 1-1-02; revised 10-17-01.) 20 (625 ILCS 5/3-654 new) 21 Sec. 3-654. Professional Sports Teams license plates. 22 (a) The Secretary, upon receipt of an application made 23 in the form prescribed by the Secretary, may issue special 24 registration plates designated as Professional Sports Teams 25 license plates. The special plates issued under this Section 26 shall be affixed only to passenger vehicles of the first 27 division and motor vehicles of the second division weighing 28 not more than 8,000 pounds. Plates issued under this Section 29 shall expire according to the multi-year procedure 30 established by Section 3-414.1 of this Code. 31 (b) The design and color of the plates is wholly within 32 the discretion of the Secretary, except that the plates 33 shall, subject to the permission of the applicable team HB4937 Engrossed -7- LRB9209512DHcd 1 owner, display the logo of the Chicago Bears, the Chicago 2 Bulls, the Chicago Black Hawks, the Chicago Cubs, the Chicago 3 White Sox, the St. Louis Rams, or the St. Louis Cardinals, at 4 the applicant's option. The Secretary may allow the plates 5 to be issued as vanity or personalized plates under Section 6 3-405.1 of the Code. The Secretary shall prescribe stickers 7 or decals as provided under Section 3-412 of this Code. 8 (c) An applicant for the special plate shall be charged 9 a $40 fee for original issuance in addition to the 10 appropriate registration fee. Of this fee, $25 shall be 11 deposited into the Professional Sports Teams Education Fund 12 and $15 shall be deposited into the Secretary of State 13 Special License Plate Fund, to be used by the Secretary to 14 help defray the administrative processing costs. 15 For each registration renewal period, a $27 fee, in 16 addition to the appropriate registration fee, shall be 17 charged. Of this fee, $25 shall be deposited into the 18 Professional Sports Teams Education Fund and $2 shall be 19 deposited into the Secretary of State Special License Plate 20 Fund. 21 (d) The Professional Sports Teams Education Fund is 22 created as a special fund in the State treasury. All moneys 23 in the Professional Sports Teams Education Fund shall, 24 subject to appropriation by the General Assembly and approval 25 by the Secretary, be deposited every 6 months into the Common 26 School Fund. 27 (625 ILCS 5/3-806.3) (from Ch. 95 1/2, par. 3-806.3) 28 Sec. 3-806.3. Senior Citizens. 29Commencing with the 1986 registration year and extending30through the 2000 registration year, the registration fee paid31by any vehicle owner who has claimed and received a grant32under the "Senior Citizens and Disabled Persons Property Tax33Relief and Pharmaceutical Assistance Act" or who is theHB4937 Engrossed -8- LRB9209512DHcd 1spouse of such a person shall be reduced by 50% for passenger2cars displaying standard multi-year registration plates3issued under Section 3-414.1, motor vehicles displaying4special registration plates issued under Section 3-616, motor5vehicles registered at 8,000 pounds or less under Section63-815(a) and recreational vehicles registered at 8,000 pounds7or less under Section 3-815(b). Widows and widowers of8claimants shall also be entitled to the reduced registration9rate for the registration year in which the claimant was10eligible.11 Commencing with the 2001 registration year and extending 12 through the 2003 registration year, the registration fee paid 13 by any vehicle owner who has claimed and received a grant 14 under the"Senior Citizens and Disabled Persons Property Tax 15 Relief and Pharmaceutical Assistance Act"or who is the 16 spouse of such a person shall be $24 instead of the fee 17 otherwise provided in this Code for passenger cars displaying 18 standard multi-year registration plates issued under Section 19 3-414.1, motor vehicles displaying special registration 20 plates issued under Section 3-616, motor vehicles registered 21 at 8,000 pounds or less under Section 3-815(a) and 22 recreational vehicles registered at 8,000 pounds or less 23 under Section 3-815(b). Widows and widowers of claimants 24 shall also be entitled to this reduced registration fee for 25 the registration year in which the claimant was eligible. 26 Commencing with the 2004 registration year, the 27 registration fee paid by any vehicle owner who has claimed 28 and received a grant under the Senior Citizens and Disabled 29 Persons Property Tax Relief and Pharmaceutical Assistance Act 30 or who is the spouse of such a person shall be $24 instead of 31 the fee otherwise provided in this Code for passenger cars 32 displaying standard multi-year registration plates issued 33 under Section 3-414.1, motor vehicles displaying special 34 registration plates issued under Section 3-616, 3-621, 3-622, HB4937 Engrossed -9- LRB9209512DHcd 1 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 2 3-647, 3-650, or 3-651, motor vehicles registered at 8,000 3 pounds or less under Section 3-815(a), and recreational 4 vehicles registered at 8,000 pounds or less under Section 5 3-815(b). Widows and widowers of claimants shall also be 6 entitled to this reduced registration fee for the 7 registration year in which the claimant was eligible. 8 No more than one reduced registration fee under this 9 Section shall be allowed during any 12 month period based on 10 the primary eligibility of any individual, whether such 11 reduced registration fee is allowed to the individual or to 12 the spouse, widow or widower of such individual. This 13 Section does not apply to the fee paid in addition to the 14 registration fee for motor vehicles displaying vanity or 15 specialpersonalizedlicense platesunder Section 3-806.1. 16 (Source: P.A. 91-37, eff. 7-1-99; revised 12-06-01.)
