 1                    AMENDMENT TO HOUSE BILL 4937

 2        AMENDMENT NO.     .  Amend House Bill 4937,  AS  AMENDED,
 3    by inserting after the enacting clause the following:

 4        "Section  3.  The  State Finance Act is amended by adding
 5    Section 5.570 as follows:

 6        (30 ILCS 105/5.570 new)
 7        Sec. 5.570.   The  Professional  Sports  Teams  Education
 8    Fund."; and

 9    by  replacing  the  introductory clause of Section 5 with the
10    following:

11        "Section 5. The  Illinois  Vehicle  Code  is  amended  by
12    changing Sections 3-621, 3-622, 3-623, 3-625, and 3-806.3 and
13    renumbering  Sections  3-648 as added by Public Act 92-79 and
14    3-648 as added by Public Act 92-467  and  by  adding  Section
15    3-654 as follows:"; and

16    by  inserting  immediately  below  the introductory clause of
17    Section 5 the following:

18        "(625 ILCS 5/3-621) (from Ch. 95 1/2, par. 3-621)
19        Sec.  3-621.  The   Secretary,   upon   receipt   of   an

 1    application,  made in the form prescribed by the Secretary of
 2    State, may issue to members of the Illinois  National  Guard,
 3    and  to  Illinois  residents who are either former members of
 4    the Illinois National  Guard  or  the  surviving  spouses  of
 5    Illinois National Guard members, special registration plates.
 6    The  special  plates issued pursuant to this Section shall be
 7    affixed only to passenger vehicles of the first  division  or
 8    motor  vehicles of the second division weighing not more than
 9    8,000 pounds subject to the staggered registration system.
10        The design and color  of  such  plates  shall  be  wholly
11    within the discretion of the Secretary of State.

13        (625 ILCS 5/3-622) (from Ch. 95 1/2, par. 3-622)
14        Sec.   3-622.    The   Secretary,   upon  receipt  of  an
15    application made in the form prescribed by the  Secretary  of
16    State, may issue to members of the United States Armed Forces
17    Reserves  who  reside  in Illinois, and to Illinois residents
18    who are either former members  of  the  United  States  Armed
19    Forces  Reserves  or  the  surviving spouses of United States
20    Armed Forces Reserve members who resided in Illinois, special
21    registration plates.  The special plates issued  pursuant  to
22    this  Section  shall be affixed only to passenger vehicles of
23    the first division or motor vehicles of the  second  division
24    weighing  not more than 8,000 pounds subject to the staggered
25    registration system.  The design and  color  of  such  plates
26    shall  be  wholly  within  the discretion of the Secretary of
27    State.

29    by inserting after the last line of the renumbered Sec. 3-651
30    of Section 5 the following:

31        "(625 ILCS 5/3-654 new)
32        Sec. 3-654.  Professional Sports Teams license plates.

 1        (a)  The Secretary, upon receipt of an  application  made
 2    in  the  form  prescribed by the Secretary, may issue special
 3    registration plates designated as Professional  Sports  Teams
 4    license plates.  The special plates issued under this Section
 5    shall  be  affixed  only  to  passenger vehicles of the first
 6    division and motor vehicles of the second  division  weighing
 7    not more than 8,000 pounds.  Plates issued under this Section
 8    shall   expire   according   to   the   multi-year  procedure
 9    established by Section 3-414.1 of this Code.
10        (b)  The design and color of the plates is wholly  within
11    the  discretion  of  the  Secretary,  except  that the plates
12    shall, subject to  the  permission  of  the  applicable  team
13    owner,  display  the  logo  of the Chicago Bears, the Chicago
14    Bulls, the Chicago Black Hawks, the Chicago Cubs, the Chicago
15    White Sox, the St. Louis Rams, or the St. Louis Cardinals, at
16    the applicant's option.  The Secretary may allow  the  plates
17    to  be  issued as vanity or personalized plates under Section
18    3-405.1 of the Code.  The Secretary shall prescribe  stickers
19    or decals as provided under Section 3-412 of this Code.
20        (c)  An  applicant for the special plate shall be charged
21    a  $40  fee  for  original  issuance  in  addition   to   the
22    appropriate  registration  fee.   Of  this  fee, $25 shall be
23    deposited into the Professional Sports Teams  Education  Fund
24    and  $15  shall  be  deposited  into  the  Secretary of State
25    Special License Plate Fund, to be used by  the  Secretary  to
26    help defray the administrative processing costs.
27        For  each  registration  renewal  period,  a  $27 fee, in
28    addition  to  the  appropriate  registration  fee,  shall  be
29    charged.  Of this  fee,  $25  shall  be  deposited  into  the
30    Professional  Sports  Teams  Education  Fund  and $2 shall be
31    deposited into the Secretary of State Special  License  Plate
32    Fund.
33        (d)  The  Professional  Sports  Teams  Education  Fund is
34    created as a special fund in the State treasury.  All  moneys

 1    in  the  Professional  Sports  Teams  Education  Fund  shall,
 2    subject to appropriation by the General Assembly and approval
 3    by the Secretary, be deposited every 6 months into the Common
 4    School Fund."; and

 5    by replacing Sec. 3-806.3 of Section 5 with the following:

 6        "(625 ILCS 5/3-806.3) (from Ch. 95 1/2, par. 3-806.3)
 7        Sec. 3-806.3. Senior Citizens.
 8        Commencing  with the 1986 registration year and extending
 9    through the 2000 registration year, the registration fee paid
10    by any vehicle owner who has claimed  and  received  a  grant
11    under  the "Senior Citizens and Disabled Persons Property Tax
12    Relief and Pharmaceutical  Assistance  Act"  or  who  is  the
13    spouse of such a person shall be reduced by 50% for passenger
14    cars   displaying  standard  multi-year  registration  plates
15    issued  under  Section  3-414.1,  motor  vehicles  displaying
16    special registration plates issued under Section 3-616, motor
17    vehicles registered at 8,000 pounds  or  less  under  Section
18    3-815(a) and recreational vehicles registered at 8,000 pounds
19    or  less  under  Section  3-815(b).   Widows  and widowers of
20    claimants shall also be entitled to the reduced  registration
21    rate  for  the  registration  year  in which the claimant was
22    eligible.
23        Commencing with the 2001 registration year and  extending
24    through the 2003 registration year, the registration fee paid
25    by  any  vehicle  owner  who has claimed and received a grant
26    under the "Senior Citizens and Disabled Persons Property  Tax
27    Relief  and  Pharmaceutical  Assistance  Act"  or  who is the
28    spouse of such a person shall  be  $24  instead  of  the  fee
29    otherwise provided in this Code for passenger cars displaying
30    standard  multi-year registration plates issued under Section
31    3-414.1,  motor  vehicles  displaying  special   registration
32    plates  issued under Section 3-616, motor vehicles registered
33    at  8,000  pounds  or  less  under   Section   3-815(a)   and

 1    recreational  vehicles  registered  at  8,000  pounds or less
 2    under Section 3-815(b).  Widows  and  widowers  of  claimants
 3    shall  also  be entitled to this reduced registration fee for
 4    the registration year in which the claimant was eligible.
 5        Commencing  with  the   2004   registration   year,   the
 6    registration  fee  paid  by any vehicle owner who has claimed
 7    and received a grant under the Senior Citizens  and  Disabled
 8    Persons Property Tax Relief and Pharmaceutical Assistance Act
 9    or who is the spouse of such a person shall be $24 instead of
10    the  fee  otherwise  provided in this Code for passenger cars
11    displaying standard  multi-year  registration  plates  issued
12    under  Section  3-414.1,  motor  vehicles  displaying special
13    registration plates issued under Section 3-616, 3-621, 3-622,
14    3-623, 3-624,  3-625,  3-626,  3-628,  3-638,  3-642,  3-645,
15    3-647,  3-650,  or  3-651, motor vehicles registered at 8,000
16    pounds or  less  under  Section  3-815(a),  and  recreational
17    vehicles  registered  at  8,000  pounds or less under Section
18    3-815(b).  Widows and widowers of  claimants  shall  also  be
19    entitled   to   this   reduced   registration   fee  for  the
20    registration year in which the claimant was eligible.
21        No more than one  reduced  registration  fee  under  this
22    Section  shall be allowed during any 12 month period based on
23    the primary  eligibility  of  any  individual,  whether  such
24    reduced  registration  fee is allowed to the individual or to
25    the spouse,  widow  or  widower  of  such  individual.   This
26    Section  does  not  apply  to the fee paid in addition to the
27    registration fee for  motor  vehicles  displaying  vanity  or
28    special personalized license plates under Section 3-806.1.
