 1        AN ACT regarding vehicles.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 5    changing Sections 13A-115 and 13B-25 as follows:

 6        (625 ILCS 5/13A-115) (from Ch. 95 1/2, par. 13A-115)
 7        Sec.   13A-115.   Effectiveness.   This  Chapter  13A  is
 8    repealed on January 1, 2003 shall cease to be effective  when
 9    the  continuation  of  the program has been implemented under
10    Chapter 13B.

13        Sec. 13B-25. Performance of inspections.
14        (a)  The  inspection  of  vehicles  required  under  this
15    Chapter shall be performed only: (i) by inspectors  who  have
16    been  certified by the Agency after successfully completing a
17    course of training and successfully passing a  written  test;
18    (ii)  at  official  inspection  stations  or official on-road
19    inspection sites established under this  Chapter;  and  (iii)
20    with equipment that has been approved by the Agency for these
21    inspections.
22        (b)  Except  as  provided in subsections (c) and (d), the
23    inspection shall consist of (i) a  loaded  mode  exhaust  gas
24    analysis; (ii) an evaporative system integrity test; (iii) an
25    on-board   computer  diagnostic  system  check;  and  (iv)  a
26    verification  that  all  required   emission-related   recall
27    repairs  have been made under Title 40, Section 51.370 of the
28    Code  of  Federal  Regulations;,  and  may  also  include  an
29    evaporative system purge test.  The owner of the  vehicle  or
30    the owner's agent shall be entitled to an emission inspection

 1    certificate issued by an inspector only if all required tests
 2    are passed at the time of the inspection.
 3        (c)  A  steady-state  idle  exhaust  gas  analysis may be
 4    substituted for the loaded mode exhaust gas analysis and  the
 5    evaporative purge system test in the following cases:
 6             (1)  On any vehicle of model year 1980 or older.
 7             (2)  On  any  heavy duty vehicle with a manufacturer
 8        gross vehicle weight rating in excess of 8,500 pounds.
 9             (3)  On any vehicle for which loaded mode testing is
10        not possible due to vehicle design or configuration.
11        (d)  The procedures contained in subsections  (d)(1)  and
12    (d)(2)  of  this Section shall be followed on model year 1996
13    and  newer  vehicles  equipped  with  OBD  on-board  computer
14    diagnostic equipment, as required.
15             (1)  Beginning  on  July  1,  2002,  and  continuing
16        through December 31, 2003, such vehicles shall be given a
17        complete on-board diagnostic  test  consistent  with  the
18        requirements of paragraphs (d)(1)(A) through (d)(1)(D) of
19        this Section.
20                  (A)  If the vehicle meets the standards set for
21             the  complete  on-board  computer  diagnostic  test,
22             neither the loaded mode exhaust gas analysis nor the
23             idle   exhaust  gas  analysis  shall  be  performed;
24             however, all other elements of the test contained in
25             subsection (b) of this Section shall be performed.
26                  (B)  If, however, the vehicle fails to meet the
27             standard  for   the   complete   on-board   computer
28             diagnostic  test,  it shall be given the loaded mode
29             exhaust  gas  analysis  or  the  idle  exhaust   gas
30             analysis, as required, and all other elements of the
31             test  contained  in  subsection (b) of this Section,
32             unless the owner of the vehicle chooses to avoid the
33             loaded mode exhaust gas analysis or idle exhaust gas
34             analysis  and  proceed  directly   under   paragraph

 1             (d)(1)(C)  of  this Section. For those vehicles that
 2             fail to meet the standard for the complete  on-board
 3             computer  diagnostic  test, the owner of the vehicle
 4             must be informed that he or she has  the  option  to
 5             have  the  vehicle  tested  using the less stringent
 6             loaded mode exhaust gas analysis or the idle exhaust
 7             gas analysis, as appropriate, for one test cycle.
 8                  (C)  If the vehicle fails to meet the  standard
 9             for  the  complete on-board computer diagnostic test
10             and the standard for the  loaded  mode  exhaust  gas
11             analysis  or  the  idle  exhaust  gas  analysis,  as
12             required,  or the owner of the vehicle has chosen to
13             avoid the loaded mode exhaust gas analysis  or  idle
14             exhaust gas analysis and proceed directly under this
15             paragraph,  the  vehicle  must  be  repaired to pass
16             either the  complete  on-board  computer  diagnostic
17             test or the loaded mode exhaust gas analysis or idle
18             exhaust  gas  analysis,  as  required, and all other
19             elements of the test contained in subsection (b)  of
20             this Section.
21                  (D)  The   on-board  computer  diagnostic  test
22             shall not be a required element  of  the  inspection
23             mandated by this Section for such vehicles for which
24             on-board computer diagnostic testing is not possible
25             due  to the vehicle's originally certified design or
26             its design as modified in  accordance  with  federal
27             law  and  regulations,  or  for  vehicles with known
28             on-board  diagnostic  communications   or   software
29             problems,  as  determined  by  the Agency.   In such
30             cases, all other elements of the inspection required
31             under  this  Section  shall  be  performed  on  such
32             vehicles, including  the  exhaust  gas  analysis  as
33             specified in subsection (b) of this Section.
34             By  April  15,  2003, the Agency shall submit to the

 1        General Assembly a report detailing the effectiveness  of
 2        the  use  of  the  on-board computer diagnostic test. The
 3        report shall include the number of failures,  the  reason
 4        for   each   failure,   the   number  of  vehicle  damage
 5        complaints,  and  the  average  wait  time  at  the  test
 6        stations.
 7             (2)  Beginning on January  1,  2004,  such  vehicles
 8        shall  be  given  a  complete  on-board  diagnostic  test
 9        consistent  with the requirements of paragraphs (d)(2)(A)
10        and (d)(2)(B) of this Section.
11                  (A)  The  loaded  mode  exhaust  gas   analysis
12             specified  in  subsection  (b) of this Section shall
13             not be performed on  such  vehicles  for  which  the
14             on-board   computer  diagnostic  test  specified  in
15             subsection (h) of this  Section  can  be  performed.
16             All  other  elements  of the inspection required for
17             such vehicles shall be performed in accordance  with
18             the provisions of this Section.
19                  (B)  The   on-board  computer  diagnostic  test
20             shall not be a required element  of  the  inspection
21             mandated by this Section for such vehicles for which
22             on-board computer diagnostic testing is not possible
23             due  to the vehicle's originally certified design or
24             its design as modified in  accordance  with  federal
25             law  and  regulations,  or  for  vehicles with known
26             on-board  diagnostic  communications   or   software
27             problems,  as  determined  by  the  Agency.  In such
28             cases, all other elements of the inspection required
29             under  this  Section  shall  be  performed  on  such
30             vehicles, including  the  exhaust  gas  analysis  as
31             specified in subsection (b) of this Section.
32    A  steady-state idle gas analysis may also be substituted for
33    the new procedures specified in subsection (b) in inspections
34    conducted in calendar year 1995 on any vehicle of model  year

 1    1990 or older.
 2        (e)  The  exhaust gas analysis shall consist of a test of
 3    an exhaust gas sample to determine whether the quantities  of
 4    exhaust  gas  pollutants  emitted  by  the  vehicle  meet the
 5    standards set for vehicles of that type under Section 13B-20.
 6    A vehicle shall be deemed to have passed this portion of  the
 7    inspection  if  the  evaluation  of  the  exhaust  gas sample
 8    indicates that  the  quantities  of  exhaust  gas  pollutants
 9    emitted  by  the  vehicle do not exceed the standards set for
10    vehicles of that type under Section 13B-20  or  an  inspector
11    certifies  that  the  vehicle  qualifies  for a waiver of the
12    exhaust gas pollutant standards under Section 13B-30.
13        (f)  The evaporative system integrity test shall  consist
14    of  a  procedure  to  determine  if  leaks  exist in all or a
15    portion of the  vehicle  fuel  evaporation  emission  control
16    system.   A  vehicle shall be deemed to have passed this test
17    if it meets the criteria that the  Board  may  adopt  for  an
18    evaporative system integrity test.
19        (g)  The evaporative system purge test shall consist of a
20    procedure  to  verify  the  purging  of  vapors stored in the
21    evaporative canister.  A vehicle  shall  be  deemed  to  have
22    passed  this test if it meets the criteria that the Board may
23    adopt for an evaporative system purge test.
24        (h)  The on-board computer diagnostic test shall  consist
25    of  accessing  the  vehicle's on-board computer system, if so
26    equipped, and reading any stored diagnostic codes that may be
27    present.  The vehicle shall be deemed  to  have  passed  this
28    test  if  the codes observed did not exceed standards set for
29    vehicles of that type under Section 13B-20.

31        Section 99. Effective date.  This Act takes  effect  upon
32    becoming law.
