92_HB5610ren HB5610 Re-Enrolled LRB9211076DHmgA 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Sections 1-117.7, 11-1005.1, and 11-1412.2 and 6 changing Sections 11-208.2 and 11-1412.1 as follows: 7 (625 ILCS 5/1-117.7 new) 8 Sec. 1-117.7. Electric personal assistive mobility 9 device. A self-balancing 2 non-tandem wheeled device 10 designed to transport only one person with an electric 11 propulsion system that limits the maximum speed of the device 12 to 15 miles per hour or less. 13 (625 ILCS 5/11-208.2) (from Ch. 95 1/2, par. 11-208.2) 14 Sec. 11-208.2. Limitation on home rule units. 15 The provisions of this Chapter of this Act limit the 16 authority of home rule units to adopt local police 17 regulations inconsistent herewith except pursuant to Sections 18 11-208,and11-209, 11-1005.1, 11-1412.1, and 11-1412.2 of 19 this Chapter of this Act. 20 (Source: P.A. 77-706.) 21 (625 ILCS 5/11-1005.1 new) 22 Sec. 11-1005.1. Electric personal assistive mobility 23 devices. Every person operating an electric personal 24 assistive mobility device upon a sidewalk or roadway has all 25 the rights and is subject to all the duties applicable to a 26 pedestrian. Nothing in this Section shall be deemed to limit 27 or preempt the authority of any home rule or non-home rule 28 unit of local government from regulating or prohibiting the 29 use of electric personal assistive mobility devices. HB5610 Re-Enrolled -2- LRB9211076DHmgA 1 (625 ILCS 5/11-1412.1) (from Ch. 95 1/2, par. 11-1412.1) 2 Sec. 11-1412.1. Driving upon sidewalk. No person shall 3 drive any vehicle upon a sidewalk or sidewalk area except 4 upon a permanent or duly authorized temporary driveway. This 5 Section does not apply to any vehicle moved exclusively by 6 human power, to any electric personal assistive mobility 7 device, nor to any motorized wheelchair. Nothing in this 8 Section shall be deemed to limit or preempt the authority of 9 any home rule or non-home rule unit of local government from 10 regulating or prohibiting the use of electric personal 11 assistive mobility devices. 12 (Source: P.A. 84-672.) 13 (625 ILCS 5/11-1412.2 new) 14 Sec. 11-1412.2. Operating an electric personal assistive 15 mobility device on a public sidewalk. A person may not 16 operate an electric personal assistive mobility device upon a 17 public sidewalk at a speed greater than 8 miles per hour. 18 Nothing in this Section shall be deemed to limit or preempt 19 the authority of any home rule or non-home rule unit of local 20 government from regulating or prohibiting the use of electric 21 personal assistive mobility devices.
