90_SB0509enr 55 ILCS 5/3-6001.5 new Amends the Counties Code to establish certain qualifications to be a candidate for the office of sheriff or to be elected or appointed to the office of sheriff. Effective immediately. LRB9000101MWmb SB509 Enrolled LRB9000101MWmb 1 AN ACT concerning county sheriffs. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Counties Code is amended by changing 5 Sections 3-7002, 3-7005, and 3-15012 and by adding Section 6 3-6001.5 as follows: 7 (55 ILCS 5/3-6001.5 new) 8 Sec. 3-6001.5. Sheriff qualifications. On or after 9 December 1, 1997, except as otherwise provided in this 10 Section, a person is not eligible to be a candidate for the 11 office of sheriff, and a person shall not be elected or 12 appointed to the office of sheriff, unless that person meets 13 all of the following requirements: 14 (1) Is a United States citizen. 15 (2) Has been a resident of the county for at least one 16 year. 17 (3) Is not a convicted felon. 18 (55 ILCS 5/3-7002) (from Ch. 34, par. 3-7002) 19 Sec. 3-7002. Cook County Sheriff's Merit Board. There is 20 created the Cook County Sheriff's Merit Board, hereinafter 21 called the Board, consisting of 5 members appointed by the 22 Sheriff with the advice and consent of the county board, 23 except that on and after the effective date of this 24 amendatory Act of 1997, the Sheriff may appoint 2 additional 25 members, with the advice and consent of the county board, at 26 his or her discretion. Of the members first appointed, one 27 shall serve until the third Monday in March, 1965 one until 28 the third Monday in March, 1967, and one until the third 29 Monday in March, 1969. Of the 2 additional members first 30 appointed under authority of this amendatory Act of 1991, one SB509 Enrolled -2- LRB9000101MWmb 1 shall serve until the third Monday in March, 1995, and one 2 until the third Monday in March, 1997. 3 Upon the expiration of the terms of office of those first 4 appointed (including the 2 additional members first appointed 5 under authority of this amendatory Act of 1991), their 6 respective successors shall be appointed to hold office from 7 the third Monday in March of the year of their respective 8 appointments for a term of 6 years and until their successors 9 are appointed and qualified for a like term. As additional 10 members are appointed under authority of this amendatory Act 11 of 1997, their terms shall be set to be staggered 12 consistently with the terms of the existing Board members. No 13 more than 3 members of the Board shall be affiliated with the 14 same political party, except that as additional members are 15 appointed by the sheriff under authority of this amendatory 16 Act of 1997, the political affiliation of the Board shall be 17 such that no more than one-half of the members plus one 18 additional member may be affiliated with the same political 19 party. No, nor shall anymember shall have held or have 20 been a candidate for an elective public office within one 21 year preceding his or her appointment. 22 The Sheriff may deputize members of the Board. 23 (Source: P.A. 86-962; 86-1028; 87-534.) 24 (55 ILCS 5/3-7005) (from Ch. 34, par. 3-7005) 25 Sec. 3-7005. Meetings. As soon as practicable after the 26 members of the Board have been appointed, they shall meet, 27 upon the call of the Sheriff, and shall organize by selecting 28 a chairman and a secretary. The initial chairman and 29 secretary, and their successors, shall be selected by the 30 Board from among its members for a term of 2 years or for the 31 remainder of their term of office as a member of the Board, 32 whichever is the shorter. Forty percentTwo membersof the 33 Board shall constitute a quorum for the transaction of SB509 Enrolled -3- LRB9000101MWmb 1 business. The Board shall hold regular quarterly meetings 2 and such other meetings as may be called by the chairman. 3 (Source: P.A. 86-962.) 4 (55 ILCS 5/3-15012) (from Ch. 34, par. 3-15012) 5 Sec. 3-15012.ExecutiveDirector. The Sheriff shall 6 appoint aan ExecutiveDirector to act as the chief 7 executive and administrative officer of the Department. The 8ExecutiveDirector shall be appointed by the Sheriff from a 9 list of 3 persons nominated by the members of the Board. He 10 or she shall serve at the pleasure of the Sheriff. If the 11ExecutiveDirector is removed, the Board shall nominate 3 12 persons, one of whom shall be selected by the Sheriff to 13 serve asExecutiveDirector. TheExecutiveDirector's 14 compensation is determined by the County Board. 15 (Source: P.A. 86-962.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.
