Amend House Bill 604 on page 3, line 3 1, after "dealer", by inserting "and its officers, directors, 4 and employees while acting within the course and scope of 5 their employment"; and 6 on page 3, by replacing lines 29 and 30 with the following: 7 "permitted user's insurance shall be primary and the new 8 vehicle dealer's insurance shall apply only in excess of the 9 permitted user's insurance and any other insurance including, 10 but not limited to, underinsured motorists coverage 11 applicable to the permitted user's liability. Where the new 12 vehicle dealer's insurance applies as excess insurance, the 13 limits shall be in the amounts of $100,000 for bodily injury 14 to, or death of, a person, $300,000 for bodily injury to, or 15 death of, 2 or more persons in any one accident, and $50,000 16 for damage to property. 17 As used in this paragraph 6, "permitted user" means a 18 person who is not an officer, director, or employee, or a 19 spouse of an officer, director, or employee of the new 20 vehicle dealer and is permitted or authorized to drive a 21 vehicle owned by the new vehicle dealer."; and 22 on page 10, line 16, after "dealer", by inserting "and its 23 officers, directors, and employees while acting within the -2- LRB9102408KSksam 1 course and scope of their employment"; and 2 on page 11, by replacing lines 10 and 11 with the following: 3 "Section 7-317, the permitted user's insurance shall be 4 primary and the used vehicle dealer's insurance shall apply 5 only in excess of the permitted user's insurance and any 6 other insurance including, but not limited to, underinsured 7 motorists coverage applicable to the permitted user's 8 liability. Where the used vehicle dealer's insurance applies 9 as excess insurance, the limits shall be in the amounts of 10 $100,000 for bodily injury to, or death of, a person, 11 $300,000 for bodily injury to, or death of, 2 or more persons 12 in any one accident, and $50,000 for damage to property. 13 As used in this paragraph 4, "permitted user" means a 14 person who is not an officer, director, or employee or a 15 spouse of an officer, director, or employee of the used 16 vehicle dealer and is permitted or authorized to drive a 17 vehicle owned by the used vehicle dealer."; and 18 on page 18, by replacing lines 23 through 30 with the 19 following: 20 "insure permitted users only to the extent provided in 21 paragraph 6 of subsection (b) of Section 5-101 and paragraph 22 4 of subsection (b) of Section 5-102;"; and 23 on page 19, by replacing lines 15 through 28 with the 24 following: 25 "accident. 26 As used in this subsection (b), "permitted user" means a 27 person who is not an officer, director, or employee or a 28 spouse of an officer, director, or employee of a new or used 29 vehicle dealer and is permitted or authorized to drive a 30 vehicle owned by the new or used vehicle dealer.".
