AMENDMENT TO SENATE BILL 3013

AMENDMENT NO. ______. Amend Senate Bill 3013 by replacing everything after the enacting clause with the following:

"Section 5. The Public Water District Act is amended by adding Section 7.3 as follows:

(70 ILCS 3705/7.3 new)

Sec. 7.3. Boil order or other Tier 1 public notification; consultation with county health department required. If a public water district issues a boil order or any other Tier 1 public notification, as defined in the Illinois Environmental Protection Agency's Primary Drinking Water Standards (35 Ill. Adm. Code 611.902), the district must initiate consultation with any county health department that serves an area subject to the order or notification as soon as is practical, but no later than 24 hours after the district learns of the violation or situation. The consultation must include notice of the estimated duration of the order or notification and the geographic area covered by the order or warning.

Section 10. The Water Service District Act is amended by adding Section 5.2 as follows:

(70 ILCS 3710/5.2 new)

Sec. 5.2. Boil order or other Tier 1 public notification; consultation with county health department required. If a water service district issues a boil order or any other Tier 1 public notification, as defined in the Illinois Environmental Protection Agency's Primary Drinking Water Standards (35 Ill. Adm. Code 611.902), the district must initiate consultation with any county health department that serves an area subject to the order or notification as soon as is practical, but no later than 24 hours after the district learns of the violation or situation. The consultation must include notice of the estimated duration of the order or notification and the geographic area covered by the order or warning.

Section 15. The Water Authorities Act is amended by adding Section 6c as follows:

(70 ILCS 3715/6c new)

Sec. 6c. Boil order or other Tier 1 public notification; consultation with county health department required. If a water authority issues a boil order or any other Tier 1 public notification, as defined in the Illinois Environmental Protection Agency's Primary Drinking Water Standards (35 Ill. Adm. Code 611.902), the authority must initiate consultation with any county health department that serves an area subject to the order or notification as soon as is practical, but no later than 24 hours after the authority learns of the violation or situation. The consultation must include notice of the estimated duration of the order or notification and the geographic area covered by the order or warning.

Section 20. The Water Commission Act of 1985 is amended by adding Section 2.5 as follows:

(70 ILCS 3720/2.5 new)

Sec. 2.5. Boil order or other Tier 1 public notification; consultation with county health department required. If a water commission issues a boil order or any other Tier 1 public notification, as defined in the Illinois Environmental Protection Agency's Primary Drinking Water Standards (35 Ill. Adm. Code 611.902), the commission must initiate consultation with any county health department that serves an area subject to the order or notification as soon as is practical, but no later than 24 hours after the commission learns of the violation or situation. The consultation must include notice of the estimated duration of the order or notification and the geographic area covered by the order or warning.

Section 99. Effective date. This Act takes effect upon becoming law.".
