 1                    AMENDMENT TO HOUSE BILL 3249
 2        AMENDMENT NO.     .  Amend House Bill 3249  by  inserting
 3    immediately below Section 100 the following:
 4        "Section  105.   Upon the payment of the sum of $3,750.00
 5    to the State of Illinois, the easement for  highway  purposes
 6    acquired  by  the People of the State of Illinois is released
 7    over and through  the  following  described  land  in  Peoria
 8    County, Illinois:
 9    Parcel No. 409519V
10        A  part of the Northeast Quarter of Section 7, Township 9
11        North, Range 8 East of  the  Fourth  Principal  Meridian,
12        being more particularly described as follows:
13        Commencing  at  the  Northwest  corner  of  the Northeast
14        Quarter of said Section 7; thence  South  89  Degrees  20
15        Minutes  00  Seconds  East  along  the  North line of the
16        Northeast Quarter of said Section 7, a distance of 282.30
17        feet; thence South 29 degrees 10 Minutes 00 Seconds East,
18        a distance of 36.25 feet to a point on the South right of
19        way line of Pioneer Parkway (SBI Route I74); thence South
20        89 Degrees 31 Minutes 02 Seconds  East  along  the  South
21        right of way line of Pioneer Parkway, a distance of 59.15
22        feet  to  the  Point  of  Beginning  of  the  tract to be
23        described; thence in a southeasterly direction along  the

 1        South  right of way line of Pioneer Parkway on a curve to
 2        the left having a  radius  of  539.38  feet  for  an  arc
 3        distance  of  136.36 feet, said curve having a long chord
 4        of 136.00 feet bearing South 82  Degrees  16  Minutes  30
 5        Seconds  East;  thence  South  89  Degrees  31 Minutes 02
 6        Seconds East along the South right of way line of Pioneer
 7        Parkway, a distance  of  293.57  feet;  thence  North  87
 8        Degrees  13 Minutes 33 Seconds West, a distance of 428.83
 9        feet to the Point of Beginning  containing  0.067  acres,
10        situated,  lying  and  being  in the County of Peoria and
11        State of Illinois.
12        Section 110.  Upon the payment of the sum of $8,000.00 to
13    the State of Illinois, the rights  or  easements  of  access,
14    crossing,  light,  air,  and  view  from,  to,  and  over the
15    following described line to FA Route 5 are  restored  subject
16    to  permit  requirements of the State of Illinois, Department
17    of Transportation:

19        A part of the Northeast Quarter of Section  28,  Township
20        28  North,  Range 5 East of the Third Principal Meridian,
21        described as follows:
22        Commencing at the  northeast  corner  of  said  Northeast
23        Quarter;  thence  South  00 degrees 13 minutes 30 seconds
24        East 5.76 feet, along the east  line  of  said  Northeast
25        Quarter,  to  the  south  right  of  way line of Reynolds
26        Street; thence South 89 degrees  57  minutes  30  seconds
27        West  92.14  feet, along said south right of way line, to
28        the Point Of Beginning of the Release Of  Access  Control
29        at the intersection of the existing easterly right of way
30        line of F.A. 5 (U.S. Route 66), said point being 230 feet
31        left  of  the survey line of said F.A. Route 5 at Station
32        1504+13.4; thence South 31 degrees 57 minutes 45  seconds

 9        Section 115. Upon the payment of the sum of $30,000.00 to
10    the  State  of  Illinois,  the  easement for highway purposes
11    acquired by the People of the State of Illinois  is  released
12    over and through the following described land in Will County,
13    Illinois:
14    Parcel 1WY0512:
15    That  part of the Southwest Quarter of Section 9, Township 36
16    North,  Range  9  East  of  the  Third  Principal   Meridian,
17    described as follows:
18    Commencing  at  the southeast corner of the Southwest Quarter
19    of said Section 9; thence  North  01  degree  29  minutes  22
20    seconds  East,  42.50  feet (Bearings assumed for description
21    purposes only) along the east line of the  Southwest  Quarter
22    of  said  Section 9, to a point on the centerline of US Route
23    30; thence Southwesterly along said centerline  and  along  a
24    curve  to  the  left having a radius of 4583.80 feet (record)
25    4585.79 feet (measured), the chord of said curve bears  South
26    87  degrees 52 minutes 43 seconds West, 95.38 feet (measured)
27    94.00 feet (record) along said centerline  of  US  Route  30;
28    thence  South 87 degrees 16 minutes, 58 seconds West, 1535.41

 5    to  the  left  having  a  radius  of  7523.86  feet and being
 6    concentric with said centerline,  the  chord  of  said  curve
 7    bears  South  02  degrees  39 minutes 23 seconds East, 467.21
 8    feet; thence South 04 degrees 26  minutes  08  seconds  East,
 9    466.23  feet  parallel  with  said centerline of US Route 30;
10    thence South 31 degrees 52 minutes  34  seconds  East,  38.78
11    feet  to  a  point  on  the  south line of the said Southwest
12    Quarter of Section 9; thence South 88 degrees 57  minutes  38

15    distance northerly of the centerline of US Route  30;  thence

19    Said parcel containing 4.971 acres, more or less.
20        Section 120.  Upon the payment of the sum of $6,850.00 to
21    the  State  of  Illinois,  the  easement for highway purposes
22    acquired by the People of the State of Illinois  is  released
23    over  and  through  the  following  described land in Madison
24    County, Illinois:
25        Parcel No. 800X898:
26        Part of Lot 1 in "Rutz-Iberg Subdivision", as recorded in
27        the Recorder's Office of Madison County, Illinois in Plat
28        Book 36 on Page 11 being a part of the Northeast  Quarter
29        of the Southwest Quarter of Section 32, Township 4 North,
30        Range  5  West  of  the Third Principal Meridian, Madison
31        County, Illinois, more particularly described as follows:
32             Commencing at an old stone found  at  the  Northwest
33        Corner  of  the  Southwest  Quarter  of  said Section 32;

 1        thence east along the north line of the Southwest Quarter
 2        of said Section 32, a distance of 1,912.61  feet  to  the
 3        northerly  extension  of  the  east line of said Lot 1 in
 4        "Rutz-Iberg Subdivision";  thence  South  00  degrees  47
 5        minutes  35  seconds  East along said northerly extension
 6        and the east line of said Lot 1,  a  distance  of  601.10
 7        feet  to  the  Southeast Corner of said Lot 1, said point
 8        being on the existing northerly right of way line  of  FA
 9        Route  12 (marked U.S. Route 40), being also the Point of
10        Beginning.
11             From said  Point  of  Beginning;  thence  continuing
12        South 00 degrees 47 minutes 35  seconds East, 53.40 feet;
13        thence  around  a  curve  to  the left having a radius of
14        4,607.75 feet, chord bearing South 70 degrees 49  minutes
15        58  seconds  West, an arc distance of 167.01 feet; thence
16        North 00 degrees 47 minutes 35 seconds West,  54.04  feet
17        to  the  Southwest  Corner  of  said Lot 1 of "Rutz-Iberg
18        Subdivision", said point being on the existing  northerly
19        right  of way line of FA Route 12 (marked U.S. Route 40);
20        thence along said existing right of way, around  a  curve
21        to  the  right  having  a  radius of 4,658.75 feet, chord
22        bearing North 71 degrees 02 minutes 28 seconds  East,  an
23        arc distance of 166.81 feet to the Point of Beginning.
24             Parcel  800X898  herein described contains 8,512 sq.
25        ft. (0.195 acre).
26             Basis of bearing is North 90 degrees 00  minutes  00
27        seconds  East  between  a  stone  found  at the Northwest
28        Corner of the Southwest Quarter of Section 32 and a  plug
29        found at the center of said Section 32, Township 4 North,
30        Range 5 West of the Third Principal Meridian.
31             And  further, in consideration of the payment of the
32        amount set  forth  above,  the  rights  or  easements  of
33        access,  crossing,  light,  air  and view to and from the
34        following described land and FA  Route  12  are  restored

 1        subject  to permit requirements of the State of Illinois,
 2        Department of Transportation:
 3             Direct access to FA Route 12 (marked U.S. Route  40)
 4        shall  be  restored  to  166.81  lin. ft. of the existing
 5        northerly right of  way  line  of  FA  Route  12  in  the
 6        Northeast Quarter of the Southwest Quarter of Section 32,
 7        Township  4  North,  Range  5 West of the Third Principal
 8        Meridian, Madison County, Illinois,  said  right  of  way
 9        line being described as follows:
10             Lot  1 of Rutz-Iberg Subdivision, a subdivision of a
11        tract of land in the Northeast Quarter of  the  Southwest
12        Quarter  of Section 32, Township 4 North, Range 5 West of
13        the Third Principal Meridian, as the  same  appears  from
14        plat thereof recorded in the Recorder's Office of Madison
15        County, Illinois in Plat Book 36 on Page 11.  Situated in
16        the County of Madison and State of Illinois.
17        Section  125.   Upon the payment of the sum of $400.00 to
18    the State of Illinois, the easement for highway  purposes  is
19    released  over  and  through the following described land and
20    the rights or easements of access, crossing, light,  air  and
21    view  from,  to  and over the following described land and FA
22    Route 12 are restored subject to permit requirements  of  the
23    State of Illinois, Department of Transportation:
24        Parcel No. 5X23712
25        Part of the Southwest Quarter of the Northwest Quarter of
26        Section  16,  Township  10  North,  Range  14 West of the
27        Second Principal Meridian, Clark County,  Illinois,  also
28        being  part of a dedication of right of way for a freeway
29        by Charles F. Beaver, recorded in Right of  Way  Book  4,
30        pages  447 and 448 in the Clark County Recorder's Office,
31        described as follows:
32             Commencing at the southwest corner of the  Northwest
33        Quarter  of  said  Section 16; thence North 88 degrees 28

 1        minutes 14 seconds East (bearings based on F.A. Route  12
 2        surveyed  centerline  bearing  of  North  67  degrees  21
 3        minutes  East  from  right of way dedication plat) 394.86
 4        feet along the south line of said  Northwest  Quarter  to
 5        the  Point  of  Beginning;  thence  North  67  degrees 21
 6        minutes 00 seconds East 220.05 feet along a line parallel
 7        with  and  35.00  feet  southerly  of  the  said   survey
 8        centerline; thence South 22 degrees 39 minutes 00 seconds
 9        East  85.00  feet  to  the  intersection  of the existing
10        southerly right of way line of said F.A. Route 12 and the
11        south line of the  Southwest  Quarter  of  the  Northwest
12        Quarter  of  said  Section 16; thence South 88 degrees 28
13        minutes 14 seconds West 235.89 feet along the south  line
14        of  said  Quarter  Section  to  the  Point  of Beginning,
15        containing 0.215 of an acre, more or less.".
