1 AMENDMENT TO HOUSE BILL 3249
2 AMENDMENT NO. . Amend House Bill 3249 on page 38, by
3 inserting below line 4, the following:
4 "Section 970. The Director of the Department of Natural
5 Resources, on behalf of the State of Illinois, is authorized
6 to execute and deliver to the Village of Ramsey, an Illinois
7 unit of local government, of the County of Fayette, State of
8 Illinois, for and in consideration of $1.00 and other good
9 and valuable consideration paid to said Department, a Quit
10 Claim Deed to the following described real property, to wit:
11 A right-of-way to Illinois Central Railroad Company over
12 and through the West Half of the Northeast Quarter, the
13 Northwest Quarter of the Southeast Quarter and the
14 Southwest Quarter of the Southeast Quarter of Section 8,
15 Township 8 North, Range 1 East of the Third Principal
16 Meridian, Fayette County, Illinois, to include and
17 comprise land of the width of 100 feet on each side of
18 said railroad measuring from the center of its tract, as
19 the same has been surveyed, located and established by
20 said company, EXCEPT that part heretofore conveyed to the
21 Ramsey Lions Club, Inc. by Quit Claim Deed dated
22 September 11, 1986 and recorded September 22, 1986 in the
23 Fayette County Recorder's Office at Book 0739, page 037;

1 ALSO EXCEPT that part heretofore conveyed to Rex M.
2 Carroll and/or Janet F. Carroll by Quit Claim Deed dated
3 June 29, 1987 and recorded July 17, 1987 in the Fayette
4 County Recorder's Office at Book 0759, page 206;
5 ALSO EXCEPT a parcel of land being a part of the
6 abandoned right-of-way of the Illinois Central Railroad
7 Company over and through the West Half of the Northeast
8 Quarter and the West Half of the Southeast Quarter of
9 Section 8, Township 8 North, Range 1 East of the Third
10 Principal Meridian, Fayette County, Illinois, more
11 particularly described as follows: Commencing at an iron
12 pin (set) at the Northwest corner of said Northeast
13 Quarter of Section 8; thence South 88 degrees 44 minutes
14 46 seconds East (assumed bearing) along the North line of
15 said Northeast Quarter of Section 8, a distance of 238.06
16 feet to an iron pin (set) at the Point of Beginning;
17 thence continuing South 88 degrees 44 minutes 46 seconds
18 East along the North line of said Northeast Quarter of
19 Section 8, a distance of 140.20 feet to an iron pin (set)
20 on the former East line of the abandoned Illinois Central
21 Railroad Company; thence South 01 degrees 47 minutes 26
22 seconds East along the former East line of the abandoned
23 Illinois Central Railroad Company, 3503.33 feet to an
24 iron pin (set); thence North 89 degrees 26 minutes 53
25 seconds West along a line parallel with the South line of
26 said Northeast Quarter of Section 8, a distance of 140.12
27 feet to an iron pin (set); thence North 01 degrees 47
28 minutes 26 seconds West along a line parallel with the
29 former East line of the abandoned Illinois Central
30 Railroad Company, 3505.04 feet to the Point of Beginning,
31 containing 11.26 acres, more or less.
32 The conveyance of real property authorized by this
33 Section shall be made subject to a restrictive covenant
34 barring the use of such real property for the storage or

1 disposal of trash, debris, junk, equipment, building
2 materials, construction materials, or road maintenance
3 materials, said restrictive covenant to run with the land.
4 The Director of Natural Resources shall obtain a
5 certified copy of the portions of this Act containing the
6 title, the enacting clause, the effective date, and this
7 Section within 60 days after its effective date, and upon the
8 receipt of the payment required by this Section, shall record
9 the certified document in the Recorder's Office in Fayette
10 County.".
